Common use of De-Identified Reports Clause in Contracts

De-Identified Reports. ‌ CMS will provide the following reports to the ACO, which will be de-identified in accordance with HIPAA requirements in 45 CFR § 164.514(b): 1. Monthly Financial Reports‌ These reports will include monthly and year-to-date information on total Medicare expenditures and expenditures for selected categories of services for Next Generation Beneficiaries. This aggregate information will not include individually identifiable health information and will incorporate de-identified data from Next Generation Beneficiaries who have opted out of data sharing. 2. Quarterly Benchmark Reports‌ CMS will provide quarterly benchmark reports (“BRs”) to the ACO to monitor ACO financial performance throughout the year.
