Days of Operation. Nothing contained in this Agreement is intended to or will require M3Sixty, in any capacity hereunder, to perform any functions or duties on any day on which the New York Stock Exchange (“NYSE”) is closed. Functions or duties normally scheduled to be performed on such days will be performed on and as of the next succeeding business day on which the NYSE is open. Notwithstanding the foregoing, M3Sixty will compute the net asset value of the Trust on each day required pursuant to Rule 22c-1 promulgated under the Act.

Functions or duties normally scheduled to be performed on such days will be performed on and as of the next succeeding business day on which the NYSE is open. Notwithstanding the foregoing, InCap will compute the net asset value of the Fund on each day required pursuant to Rule 22c-1 promulgated under the Act.

Nothing contained in this Agreement is intended to or will require MSS in any capacity hereunder, to perform any functions or duties on any holiday, day of special observance or another day on which the New York Stock Exchange ("NYSE") is closed. Functions or duties normally scheduled to be performed on such days will be performed on the next succeeding business day on which the NYSE is open. Notwithstanding the foregoing, MSS will compute the net asset value of the Fund on each day required pursuant to Rule 22c-1 under the Act.

Nothing contained in this Agreement is intended to or will require FPS, in any capacity hereunder, to perform any functions or duties on any holiday, day of special observance or any other day on which the New York Stock Exchange ("NYSE") is closed. Functions or duties normally scheduled to be performed on such days will be performed on, and as of, the next succeeding business day on which the NYSE is open. Notwithstanding the foregoing, FPS will compute the net asset value of the Trust on each day required pursuant to Rule 22c-1 promulgated under the Act. Section 8.
Days of Operation. The Program will operate on all days when the Federal Reserve Bank of New York is open for business. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SOFI BANK, STABLE OR THEIR RESPECTIVE AFFILIATES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES OF ANY NATURE, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY) OR OTHERWISE, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, GOODWILL OR BUSINESS INTERRUPTION. Legal Process: Stable, SoFi Bank, and the Receiving Banks may comply with any writ of attachment, execution, garnishment, tax, levy, restraining order, subpoena, warrant or other legal process, which such party reasonably and in good faith believes to be valid. SoFi Bank may notify you of such process by telephone, electronically or in writing. You agree to indemnify, defend and hold Stable, SoFi Bank, and the Receiving Banks harmless from all actions, claims, liabilities, losses, costs, attorneys’ fees, and damages associated with their compliance with any process that such party believes reasonably and in good faith to be valid. You further agree that Stable, SoFi Bank, and the Receiving Banks may honor legal process that is served personally, by mail, or by facsimile transmission at any of their respective offices (including locations other than where the funds, records or property sought is held), even if the law requires personal delivery at the office where your Program Deposit records are maintained.
Days of Operation. The Center will operate Monday through Friday throughout the year except for: Columbus Day, Presidents’ Day, New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the day after Thanksgiving Day, the day before Christmas, Christmas Day, and certain other days specified by Center from time to time. In addition, the Center will operate for limited hours on the following days: New Years Eve and certain other days specified by Center from time to time. Full tuition is charged for weeks in which these holidays occur. When the holiday falls on a Saturday, the Center will be closed Friday. When the holiday falls on a Sunday, the Center will be closed Monday. There will be no deduction from tuition for closing due to weather conditions when deemed necessary.
Days of Operation. The Customer Service Team is available Monday through Friday, 8:30 a.m. until 5:30 p.m. (Eastern Time) except for New Year’s Day, Xxxxxx Xxxxxx Xxxx Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day (each day the Account is open is referred to herein as a “Business Day”). Deposits to, and transfers or withdrawals from your Account may only be made on days that the Account Custodian and any related Sub-Custodian and Insured Depository is open for business.
