Data input may belong to the following categories:\n(I) Input by the user (push model). This may be data manually entered to the system, uploaded as files or provided to the web service through aggregation or APIs. In all three cases the web service provider needs to take reasonable measures in order to ensure that the data provided by the user are granted with such a license so that processing and data output is actually legal. This has to be communicated to the end user through the web service terms and conditions. However, the service provider has no special obligation to clear rights over the input content/ data if the end user agrees with the terms and conditions and declares that all rights have been cleared. A process of notice and take down would be particularly helpful in cases where a third party identifies a rights violation. In any case the service provider has to inform the data/content provider regarding the type of processing (especially if it involves personal data), the degree to which such processing will take place on the web service provider's site or somewhere else, what kind of processing will take place, if the data are going to be retained and to whom the data are to be shared with or disseminated to.\n(II) Input by collecting data from third sources (pull model). This is the case where the web service provider actively seeks to obtain content from third parties either through specific licensing schemes or through a fair use/ dealing regime. Again, the preceding analysis regarding clearing of rights and what applies to web crawling is useful. The service provider is always encouraged either to use material that fall in the public domain or obtain explicit licenses and only do web crawling after mitigating risks as indicated above. Obtaining the necessary licenses also includes making redistribution agreements, passing licenses to the end user or use Open Public Licenses such as Creative Commons or \u2587\u2587\u2587\u2587 licenses. It is important to note that the license should not only cover redistribution but also the types of processing that the web service requires. In the case where the processing is not perceptible to third parties and the service provider provides a data output that is based on the original work but is not its derivative work, while a license allowing adaptations of the work is technically required the risk of a lawsuit is extremely low. In all cases documentation of the due diligence steps is highly recommended. Another scenario here is the case where the web-service provider is not given Data to process for the user but a list of URL and web sites. The web service would then crawl and process them for the user.", "hash": "588cb77338f46cd13f237897ef4e69ee", "id": 5}, {"snippet_links": [{"key": "responsible-for", "type": "clause", "offset": [10, 25]}, {"key": "data-and-other-information", "type": "clause", "offset": [44, 70]}, {"key": "by-or-on-behalf-of", "type": "definition", "offset": [79, 97]}, {"key": "in-connection-with", "type": "clause", "offset": [164, 182]}, {"key": "agency-data", "type": "clause", "offset": [197, 208]}, {"key": "complete-and-accurate", "type": "clause", "offset": [214, 235]}, {"key": "data-and-information", "type": "definition", "offset": [272, 292]}, {"key": "relating-to", "type": "definition", "offset": [293, 304]}, {"key": "identifiable-individuals", "type": "definition", "offset": [319, 343]}, {"key": "identifiable-data", "type": "definition", "offset": [346, 363]}, {"key": "all-information", "type": "clause", "offset": [383, 398]}, {"key": "based-on", "type": "clause", "offset": [453, 461]}, {"key": "the-agency", "type": "clause", "offset": [462, 472]}, {"key": "received-by", "type": "definition", "offset": [481, 492]}, {"key": "not-responsible", "type": "definition", "offset": [521, 536]}, {"key": "resulting-from", "type": "definition", "offset": [594, 608]}, {"key": "a-non", "type": "clause", "offset": [661, 666]}, {"key": "right-to-access", "type": "clause", "offset": [677, 692]}, {"key": "provision-of-service", "type": "clause", "offset": [770, 790]}, {"key": "the-term-of-this-agreement", "type": "clause", "offset": [805, 831]}, {"key": "right-to-reproduce", "type": "clause", "offset": [871, 889]}, {"key": "the-processing", "type": "clause", "offset": [1050, 1064]}, {"key": "use-of-the-service", "type": "clause", "offset": [1112, 1130]}, {"key": "data-output", "type": "definition", "offset": [1133, 1144]}, {"key": "source-of", "type": "definition", "offset": [1191, 1200]}, {"key": "between-the-parties", "type": "clause", "offset": [1215, 1234]}, {"key": "and-interest", "type": "clause", "offset": [1278, 1290]}, {"key": "data-and-data", "type": "clause", "offset": [1312, 1325]}, {"key": "agreement-to", "type": "definition", "offset": [1367, 1379]}, {"key": "new-features", "type": "clause", "offset": [1466, 1478]}, {"key": "derivative-works", "type": "clause", "offset": [1493, 1509]}, {"key": "output-data", "type": "clause", "offset": [1608, 1619]}, {"key": "intellectual-property-rights", "type": "definition", "offset": [1635, 1663]}, {"key": "granted-to", "type": "definition", "offset": [1692, 1702]}, {"key": "service-providers", "type": "clause", "offset": [1814, 1831]}, {"key": "other-contractors", "type": "clause", "offset": [1836, 1853]}, {"key": "rights-and-licenses", "type": "clause", "offset": [1870, 1889]}, {"key": "disclosure-of", "type": "clause", "offset": [1968, 1981]}, {"key": "each-party-will", "type": "clause", "offset": [2001, 2016]}, {"key": "the-term-of-the-agreement", "type": "clause", "offset": [2038, 2063]}, {"key": "physical-safeguards", "type": "definition", "offset": [2108, 2127]}, {"key": "to-ensure", "type": "clause", "offset": [2137, 2146]}, {"key": "security-and-confidentiality", "type": "clause", "offset": [2151, 2179]}, {"key": "integrity-of", "type": "clause", "offset": [2273, 2285]}, {"key": "control-of", "type": "definition", "offset": [2411, 2421]}, {"key": "such-party", "type": "clause", "offset": [2422, 2432]}, {"key": "notify-the", "type": "clause", "offset": [2451, 2461]}, {"key": "other-party", "type": "definition", "offset": [2462, 2473]}, {"key": "in-the-event-of", "type": "definition", "offset": [2474, 2489]}, {"key": "unauthorized-access", "type": "clause", "offset": [2649, 2668]}, {"key": "contract-representative", "type": "definition", "offset": [2734, 2757]}, {"key": "termination-or-expiration-of-this-agreement", "type": "clause", "offset": [2772, 2815]}, {"key": "without-undue-delay", "type": "definition", "offset": [2833, 2852]}, {"key": "return-to", "type": "definition", "offset": [2853, 2862]}, {"key": "the-option", "type": "clause", "offset": [2877, 2887]}, {"key": "tangible-items", "type": "clause", "offset": [2911, 2925]}, {"key": "certification-of", "type": "clause", "offset": [3006, 3022]}, {"key": "destruction-or-return", "type": "clause", "offset": [3028, 3049]}], "size": 1, "samples": [{"hash": "hKwuvPmUosX", "uri": "/contracts/hKwuvPmUosX#data-input", "label": "Ridealong App Use Agreement", "score": 27.4858394985, "published": true}], "snippet": "Agency is responsible for ensuring that all data and other information entered by or on behalf of Agency or otherwise provided to RideAlong or obtained from Agency in connection with the Service (\u201cAgency Data\u201d) is complete and accurate.
