Dark Fiber Loops. 44.11.1.1. Dark Fiber is an optical transmission facility without attached multiplexing, aggregation or other electronics. Dark Fiber is unactivated fiber optic cable, deployed by Sprint, that has not been activated through connections to optronics that light it, and thereby render it capable of carrying communications.

Dark Fiber Loops. 3.4.3.1 Effective as of March 11, 2005, and subject to the transition requirements set forth in Section 3.4.3.2 below, Verizon is not required to provide RNK with access to a § 251(c)(3) Dark Fiber Loop on an unbundled basis.

Dark Fiber Loops. Notwithstanding anything set forth in the Terms and subject to the conditions set forth in Section 1(F) of this Supplemental Agreement No. 2, Verizon shall provide Allegiance with access to a Dark Fiber Loop in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Loops as the case may be, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Notwithstanding anything else set forth in this Supplemental Agreement No. 2 or in the Terms or Tariff, Verizon shall provide Allegiance with nondiscriminatory access to a Dark Fiber Loop in accordance with, but only to the extent required by, Applicable Law.
Dark Fiber Loops. The Declassified Network Elements as contemplated under this Section do not impact any separate obligations of Verizon to provide such Network Elements under other applicable state of federal law, including 47 U.S.C. § 271.
Dark Fiber Loops. 3.3.2.1 Subject to the change of law provisions in the Agreement, as modified by this Amendment, and in accordance with the Transition Period set forth herein, Verizon shall not be required to provide CLEC with nondiscriminatory access to Dark Fiber Loops on an unbundled basis.
