Damage and Costs Clause Samples

The Damage and Costs clause defines the responsibilities and liabilities of parties regarding any harm, loss, or expenses that may arise during the course of the agreement. Typically, this clause outlines what types of damages or costs are covered, such as property damage, personal injury, or legal fees, and specifies which party is responsible for paying or reimbursing these amounts. Its core practical function is to allocate financial risk between the parties, ensuring that there is clarity about who bears the burden of specific losses or expenses, thereby reducing disputes and uncertainty if issues occur.
