D isputes. 14.1 As indicated in the Preamble (e), the primary mechan ism for resolution of any disputes shall be negotiation within the Collaboration in the first instance and then if necessary in the RRB. Should these fail to conclude, the following three mechanisms shall apply, as appropriate. Any dispute between Fu n ding Agencies shall be resolved by negotiation or, failing that, by arbitration through the President of the CERN Council, who will use defined arbitration procedures where they exist and will otherwise adopt one at his or her discretion. Any dispute between a Funding Agency and CERN will be resolved using standard CERN procedures for the resolution of such disputes.
