Customer’s Property. Title to and right of immediate possession of any property, including without limitation, patterns, tools, jigs, dies, equipment or materials furnished or paid for by the Customer shall remain in Customer. No articles made therefrom shall be furnished by Supplier to any other party without Customer’s prior written consent. Supplier may not use Customer’s property for any purpose outside the scope of Customer’s orders. Supplier shall keep adequate records of such property, which shall be made available to Customer upon request, and shall store, protect, preserve, repair and maintain such Customer’s property in accordance with sound industrial practice, all at Supplier’s expense. Unless otherwise agreed to by Customer, Supplier shall insure Customer’s interest in such the property against all risks of theft, loss or damage (including extended coverage). Copies of certificates of insurance evidencing this coverage will be furnished to Customer on demand. In the event that Xxxxxxxx’s property becomes lost or damaged Supplier agrees to pay for or replace the property, at Supplier’s expense, at Customer’s request. Supplier shall upon Customer’s request return the property at Supplier’s expense.
Customer’s Property. All property supplied to the Company by or on behalf of the Customer which is held by the Company for the purposes of the Contract or in transit to or from the Customer, shall be deemed to be entirely at the Customer’s risk and the Company shall not be liable for any loss of or damage to such property whilst in possession of the Company or in transit as afore said unless such loss or damage is due directly to the negligence of the Company, its employees or agents. In no circumstances whatsoever will the Company be liable for any consequential loss or damage arising there from. The Customer shall insure all such property for all risks.
Customer’s Property. 5.3.1 The Service Provider shall store parts and equipment removed from the Customer’s Aircraft, or shipped to the Service Provider for use or installation on the Customer’s Aircraft, in an area secure and separate from the work being done for other customers. No such parts or equipment may be used for other work without the Customer's prior written permission. Any equipment loaned by the Customer to the Service Provider for use in performing the Services shall be maintained by it in proper working order in accord- ance with the manufacturer’s instructions, and returned to the Customer when all work is completed in the same condition as when received, save for ordinary wear and tear.
Customer’s Property. The provider will only maintain fire and extended coverage on property belonging to the customer while the property is in the provider’s possession. The provider’s liability for this property will not exceed the amount recoverable from insurance. Additional insurance coverage may be obtained if it is requested in writing, and if the premium is paid to the provider. terms and conditions
Customer’s Property. 9.1 If the provision of any Services requires use of the Customer's equipment, the Customer will ensure that the Synergistic Resources Staff are given such access to the equipment as is reasonably necessary to facilitate the provision of the Services.
Customer’s Property. If Buyer provides property of its Customer, other than the Government, to Seller, such Customer’s property will be subject to the provisions regarding Customer’s property in the FAR/DFARS chart governing this Contract, or in the absence of such provisions in the FAR/DFARS chart, to the provisions regarding Buyer’s property section A of Attachment 10 of this Agreement.
Customer’s Property. BalsamWest and its affiliates, and each of their agents, representatives and employees, will be held harmless by Customer and its agents and representatives for any loss or damage to equipment or other property of Customer and its affiliates and each of their agents and representatives, that may be brought onto, used, or stored at any Datacenter, as such is done at the equipment owner’s sole risk. Customer may, at its own expense, carry insurance which provides the necessary protection against loss or damage. Any such insurance will waive subrogation against BalsamWest and its affiliates, and each of their agents, representatives and employees.
Customer’s Property. Treat the customer’s property with due care and respect and take all necessary precautions to prevent damage when moving the customer’s furniture and belongings. At no time is the Sub-Contractor to use any of the customer’s property.
Customer’s Property a. Property supplied by or on behalf of the customer whilst in the company’s possession or in transit shall be entirely at the customer’s risk unless otherwise agreed in writing between the parties.
Customer’s Property. Materials, equipment, tools, dies, moulds, copyright, design rights or any other forms of intellectual property rights in all drawings, specifications and data supplied by Customer to Supplier or not so supplied but used by Supplier specifically in the manufacture of the Goods shall at all times be and remain the exclusive property of Customer but shall be held by Supplier in safe custody at its own risk and maintained and kept in good condition by Supplier until returned to the Customer and shall not be disposed of other than in accordance with Customer´s written instructions, nor shall such items be used otherwise than as authorised by Customer in writing.
