Customer’s Processing of Personal Data. Customer shall, in its use of the Services, Process Personal Data in accordance with the requirements of Data Protection Laws and Regulations. For the avoidance of doubt, Customer’s instructions for the Processing of Personal Data shall comply with Data Protection Laws and Regulations. Customer shall have sole responsibility for the means by which Customer acquired Personal Data.

The customer is responsible for the control of Personal Data complying with its obligations as a Data Controller under Data Protection Laws, in particular for justification of any transfer of Customer Data to MailerLite and for its decisions and actions regarding the Processing and use of Personal Data.

The Customer acknowledges and undertakes to comply with the Data Protection Laws and Regulations, especially but not limited to data retention periods and collection of the consent of the affected data subjects. For the avoidance of doubt, Xxxxxxxx’s instructions for the Processing of Personal Data shall comply with Data Protection Laws and Regulations and AudioCodes shall not be under any obligation to verify compliancy. However, if AudioCodes considers that an instruction of the Customer might infringe this Regulation or other Union or Member State data protection provisions, it is entitled to refuse to execute such instruction. In such situation, AudioCodes will immediately inform the Customer. Customer shall have sole responsibility for the accuracy, quality, and legality of Personal Data and the means by which Customer acquired Personal Data. The Customer shall hold AudioCodes completely harmless in case of any claim by a third party in this respect.

Customer shall have sole responsibility for the means by which Customer acquired Personal Data and for the accuracy, quality, and legality of Customer Data provided to ClickDimensions within the framework of the Services. Customer acknowledges that its use of the Services will not knowingly or intentionally violate the rights any Data Subject that has opted- out from sales or other disclosures of Personal Data, to the extent applicable under the applicable US Data Protection Laws.
Customer’s Processing of Personal Data. Customer, in its use of the Services, and Customer’s instructions to the Processor, shall comply with the applicable Data Protection Laws. Customer shall establish and have any and all required legal bases in order to collect, Process and transfer to Processor the Personal Data, and to authorize the Processing by Processor, and for Processor’s Processing activities on Customer’s behalf, including the pursuit of ‘business purposes’ as under the CCPA (to the extent applicable).

Without limitation, Customer shall comply with any and all transparency-related obligations (including, without limitation, displaying any and all relevant and required privacy notices or policies) and shall have any and all required legal bases in order to collect, Process and transfer to Data Processor the Personal Data and to authorize the Processing by Data Processor of the Personal Data which is authorized in this DPA.

For the avoidance of doubt, Xxxxxxxx’s instructions to the Flipnode for the Processing of Personal Data shall comply with Data Protection Laws and Regulations. In addition, Customer shall have sole responsibility for the accuracy, reliability, quality, and legality of Personal Data, and the means by which Customer acquired Personal Data, including providing any required notices to, and obtaining any necessary consent from, its employees, agents or third parties to whom it extends the benefits of the Services or whose Personal Data are Processed in Customer’s Use of the Services. It is expressly stated that Customer is solely responsible (i) for the legality of the purposes of the Processing, (ii) for the necessity of the Processing to serve these purposes, (iii) to inform any and all Data Subjects, whose Personal Data is processed by using the Services, about the scope, the purpose, the duration and the means of the Processing, their rights with respect to the Processing (iv) to acquire the consent of the Data Subjects, whose Personal Data is being processed by using the Services, where applicable v) to conduct a Data Protection Impact Assessment Study (DPIA) within the meaning of Article 35 and 36 GDPR, where applicable.
Customer’s Processing of Personal Data. Customer shall have sole responsibility for the accuracy and quality of Personal Data, the means by which Customer acquired such Personal Data and ensure compliance with laws as it relates to the foregoing. Customer acknowledges that it is responsible for properly implementing access and use controls and configuring certain features and functionalities that Customer may elect to use and that it will do so in such manner that Customer deems adequate to maintain appropriate security, protection, deletion, and backup of Personal Data. PandaDoc will be entitled to rely solely on Customer’s instructions relating to Personal Data Processed by PandaDoc.
Customer’s Processing of Personal Data. Customer is solely responsible for its compliance with the Data Protection Laws and Regulations, including without limitation the lawfulness of any transfer of Personal Data to Bugcrowd and Bugcrowd’s Processing of Personal Data. For the avoidance of doubt, but not by way of limitation, Customer’s instructions for the Processing of Personal Data must comply with Data Protection Laws and Regulations. Customer shall have sole responsibility for the accuracy, quality, and legality of Personal Data and the means by which Customer acquired Personal Data, including providing any required notices to, and obtaining any necessary consent from Data Subjects. Customer takes full responsibility to keep the amount of Personal Data provided to Bugcrowd to the minimum necessary for the performance of the Services. Customer shall be solely responsible for establishing and maintaining any data processing registers or overview as required by any applicable law, including without limitation the Data Protection Laws and Regulations. Customer acknowledges and consents that certain business operations necessary for the fulfilment of Xxxxxxxx’s services hereunder may have been transferred or will be transferred in the future to one or more dedicated Bugcrowd affiliates independently managing the provision of such Services.
