Customer Facilities Contingencies. As a condition of this agreement and any related service orders, the Customer shall allow MdBC unfettered access to any strands of fiber optic cable on any associated laterals, existing or constructed, attached or spliced to the MdBC backbone. All laterals shall constitute and contain a minimum of twelve fiber optic strands and upon initial splicing of the MdBC backbone to the lateral, the customer shall splice or allow the splicing of one (1) additional pair of fibers for use by MdBC. In lieu of this, both parties may agree, in writing, to allow MdBC access to any customer owned conduit or innerduct which exists or may be constructed by the customer to the customer sites related to this service order.
