Common use of Customary Billing Clause in Contracts

Customary Billing. The costs of Services as to which the Customary Billing method applies shall be equal to (i) the costs charged to Too, Inc. by The Limited for such Services immediately prior to the Distribution Date (it being understood that from and after the Distribution Date such costs may be increased by The Limited in a manner consistent with the manner in which such costs were increased from time to time prior to the Distribution Date) plus (ii) 5 percent. Notwithstanding the foregoing, any third-party expenses as well as out-of-pocket expenses incurred by The Limited in connection with the provision of any Services as to which the Customary Billing method applies shall be passed through to Too, Inc. without the 5 percent mark-β–‡β–‡.
