Cross Endorsement Clause Samples
Cross Endorsement. Where the Licensee has given its consent to the Authorised Representative holding an authorisation to provide financial services issued by another person, the Authorised Representative represents and warrants that in respect of each such person that:
(a) such person is the holder of an AFSL whose identity has been notified to the Licensee and who has appointed the Authorised Representative as its authorised representative;
(b) the licensee mentioned in paragraph (a) has consented in accordance with section 916C of the Corporations Act to the Licensee appointing the Authorised Representative as its authorised representative; and
(c) the Authorised Representative will disclose to each Client any conduct by the Authorised Representative that is not within the authority granted by the Licensee, before the Client relies on that conduct.
Cross Endorsement. Where the Licensee has given its consent to the Authorised Representative holding an authorisation to provide Financial Planning Services issued by another person or AFS Licensee, the Authorised Representative represents and warrants that in respect of each such person or AFS Licensee that:
(a) such person or AFS Licensee is the holder of an AFSL and subject to clause 4.1(q), whose identity has been notified to the Licensee and who has appointed the Authorised Representative as its authorised representative;
(b) the licensee mentioned in clause 9.2
(a) has consented in accordance with section 916C of the Corporations Act to the Licensee appointing the Authorised Representative as its authorised representative; and
(c) the Authorised Representative will disclose to each Client, any conduct by the Authorised Representative that is not within the authority granted by the Licensee, before the Client relies on that conduct.
Cross Endorsement. Where NAB has given its consent to the Authorised Representative holding an authorisation to provide financial services issued by another person, the Authorised Representative represents and warrants that in respect of each such person that:
(a) such person is the holder of an AFSL whose identity has been notified to NAB and who has appointed the Authorised Representative as its authorised representative;
(b) the licensee mentioned in paragraph (a) has consented in accordance with section 916C of the Corporations Act to NAB appointing the Authorised Representative as its authorised representative; and
(c) the Authorised Representative will disclose to each Client any conduct by the Authorised Representative that is not within the authority granted by NAB, before the Client relies on that conduct.
Cross Endorsement. Where MLC Advice has given its consent to the Authorised Representative holding an authorisation to provide financial services issued by another person, the Authorised Representative represents and warrants that in respect of each such person that:
(a) such person is the holder of an AFSL whose identity has been notified to MLC Advice and who has appointed the Authorised Representative as its authorised representative;
(b) the licensee mentioned in paragraph (a) has consented in accordance with section 916C of the Corporations Act to MLC Advice appointing the Authorised Representative as its authorised representative; and
(c) the Authorised Representative will disclose to each Client any conduct by the Authorised Representative that is not within the authority granted by MLC Advice, before the Client relies on that conduct.
