Covered Active Duty. In the case of a member of a regular component of the Armed Forces; duty during the deployment of the member with the Armed Forces to a foreign country. • In the case of a member of a reserve component of the Armed Forces, duty during the deployment of the member with the Armed Forces to a foreign country under a call or order to active duty in support of a contingency operation.
Covered Active Duty. For members of the Regular Armed Forces, covered active duty is duty during deployment of the member with the Armed Forces to a foreign country. For members of the Reserve components of the Armed Forces (members of the National Guard and Reserves), covered active duty is duty during deployment of the member with the Armed Forces to a foreign country under a call or order to active duty in a contingency operation. Deployment to a foreign country means deployment to areas outside of the United States, the District of Columbia, or any Territory or possession of the United States. It also includes deployment to international waters.
Covered Active Duty. In order for the employee to take leave for a qualifying exigency under 2(e), the military member must be on covered active duty, under a call to covered active duty status, or have been notified of an impending call or order to covered active duty.
