COVENANTS TO BE. PERFORMED AT LANDLORD'S OPTION - Where any clause in this Lease gives the Landlord the option of having the Landlord or Tenant perform the covenants set out in such clause, the Tenant shall perform such covenants unless the Tenant is otherwise directed by way of written notice from the Landlord.

COVENANTS TO BE. Set Out in Bond Ordinance. Any Bond Resolution passed by the Authority shall contain language to the following effect: Any holder or registered owner of a bond in any civil action, mandamus, or other proceeding, may enforce and compel performance of all duties required by law to be performed by the Authority or by any customers of the Authority, including the making of rates and charges, the collecting of sufficient revenue and the application thereof, as provided by applicable law, and including, expressly, all of the terms and provisions of Articles 6, 7 and 16 of the Contract [referring to this Contract], if the nonperformance of such duties would substantially impair the ability of the AuthorityCharter Customer to make the payments required by the Contracts, or result in the Authority being in default under any Bond Resolution, or adversely affect the rating of any of the Authority’s Bonds.
