Common use of Covenant Breaches Clause in Contracts

Covenant Breaches. The Borrower, any Guarantor or any of their respective Subsidiaries shall: (i) fail to perform or observe any covenant contained in Section 8.03, Section 8.05, Section 8.06, Section 8.11, Section 8.12, Section 8.13 or Article IX; (ii) fail to perform or observe any covenant contained in Section 8.02(a) if such failure shall remain unremedied for 15 days after the occurrence of such breach or failure; or (iii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clauses (i) or (ii) above or any other provision of this Section 10.01, if such failure shall remain unremedied for 30 days after the occurrence of such breach or failure;

Covenant Breaches. The Borrower, any Guarantor or any of their respective Subsidiaries shall: : (i) fail to perform or observe any covenant covenant, condition or agreement contained in Section 8.032.05, Section 8.055.03, Section 8.065.02(a) or 5.02(c), Section 8.115.05, Section 8.125.06, Section 8.13 5.09, Section 5.11, Section 5.12, Section 5.13, Section 5.16 or Article IX; VI; (ii) fail to perform or observe any covenant contained in Section 8.02(a) if such failure shall remain unremedied for 15 days after the occurrence of such breach or failure; or (iii) fail to perform or observe any other term or covenant covenant, condition or agreement set forth in this Agreement or in any other Loan Document which is not covered by clauses (iSection 7.01(c)(i) or (ii) above or any other provision of this Section 10.017.01, if such failure shall remain unremedied for 30 thirty (30) days after the occurrence of such breach or failure;; (

Covenant Breaches. The Borrower, any Guarantor or any of their respective Subsidiaries shall: shall fail to (i) fail to perform or observe any covenant contained in Section 8.032.15(b), Section 8.055.06(g), Section 8.065.12, Section 8.11, Section 8.12, Section 8.13 5.13 or Article IX; VI or (ii) fail to perform or observe any covenant contained in Section 8.02(a5.02(a) if such failure shall remain unremedied for 15 days after the occurrence of such breach or failure; or failure or (iii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clauses (i) or (ii) above or any other provision of this Section 10.017.01, if such failure shall remain unremedied for 30 days after the occurrence of such breach or failure;

Covenant Breaches. The Borrower, any Guarantor or any of their respective Subsidiaries or, as to clause (iii) the Parent, shall: (i) fail to perform or observe any covenant contained in Section 8.032.16(a)(v), Section 8.055.02(a) or (c), Section 8.065.03, Section 8.115.05, Section 8.125.06, Section 8.13 5.09, Section 5.13, Section 5.15, Section 5.21 or Article IXVI; (ii) fail to perform or observe any other term or covenant contained set forth in this Agreement or in any other Loan Document which is not covered by clause (i) above or any other provision of this Section 8.02(a) 7.01, if such failure shall remain unremedied for 15 30 days after the occurrence of such breach or failure; or (iii) fail to perform or observe any other term or covenant set forth in this the Parent Pledge Agreement or in any other Loan Document which is not covered by clauses (i) or (ii) above or any other provision of this Section 10.017.01, if such failure shall remain unremedied for 30 days after the occurrence of such breach or failure;

Covenant Breaches. The Borrower, any Guarantor or any of their respective Subsidiaries shall: (i) fail to perform or observe any covenant covenant, condition or agreement contained in Section 8.032.05, Section 8.055.03, Section 8.065.02(a) or 5.02(c), Section 8.115.05, Section 8.125.06, Section 8.13 5.09, Section 5.11, Section 5.12, Section 5.13, Section 5.16 or Article IXVI; (ii) fail to perform or observe any covenant contained in Section 8.02(a) if such failure shall remain unremedied for 15 days after the occurrence of such breach or failure; or (iii) fail to perform or observe any other term or covenant covenant, condition or agreement set forth in this Agreement or in any other Loan Document which is not covered by clauses (iSection 7.01(c)(i) or (ii) above or any other provision of this Section 10.017.01, if such failure shall remain unremedied for 30 thirty (30) days after the occurrence of such breach or failure;

Covenant Breaches. The Borrower, any Guarantor or any of their respective Subsidiaries shall: (i) fail to perform or observe any covenant contained in Section 8.032.15(b), Section 8.055.03, Section 8.065.05, Section 8.115.06, Section 8.125.09, Section 8.13 5.12, Section 5.13 or Article IXVI; (ii) fail to perform or observe any covenant contained in Section 8.02(a5.02(a) or (c) if such failure shall remain unremedied for 15 days after the occurrence of such breach or failure; or (iii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clauses (i) or (ii) above or any other provision of this Section 10.017.01, if such failure shall remain unremedied for 30 days after the occurrence of such breach or failure;
