Common use of Court Appearance Leave Clause in Contracts

Court Appearance Leave. Leave shall be granted for appearance before a court, legislative committee, or other judicial or quasi-judicial body in response to a subpoena or other direction of proper authority for job-related purposes other than those instituted by the employee or the exclusive representative. Leave shall also be granted for attendance in court in connection with an employee’s official duty, which shall include any necessary travel time. Such employee shall be paid at the employee’s regular rate of pay but shall remit to their supervisor the amount received for, exclusive of expenses, serving as a witness as required by the court. Any employee who must appear and testify in private litigation, not as an officer of the State but as an individual, shall be required to use vacation leave, leave of absence without pay, or compensatory time, unless, by mutual consent with the Employer or its designee, the employee is able to work an equivalent number of hours during the pay week to compensate for the hours lost.
