Costs and Liens. Lessee shall pay when due all costs for alterations and shall keep the Premises, the Project and the underlying property free from any liens arising out of worked performed for, materials furnished to or obligation incurred by Xxxxxx. Lessee shall give Lessor no less than three (3) and no more than five (5) days prior written notice of the date such alterations will commence, to enable Lessor to post such Notices of Nonresponsibility as Lessor deems appropriate. Lessee shall promptly pay all contractors and materials suppliers furnishing labor and materials in connection with any such alterations, so as to avoid the filing of any lien against the Premises or the Project. If any such lien is filed, Lessee shall cause the same to be released no later than ten (10) days following the filing thereof. If Xxxxxx fails to cause the release of any lien as provided above, Lessor may pay the demand of the lien claimant in full or otherwise cause the release of such lien, and Xxxxxx shall reimburse Lessor for all such costs upon demand.

Costs and Liens. Tenant shall pay all costs for construction on the Premises performed by it, or on its behalf, and Tenant shall keep the Premises free and clear of all construction and other liens resulting from construction done by or on behalf of Tenant. Tenant shall have the right to contest the correctness or the validity of any such lien if, immediately following demand therefor by Landlord, Tenant procures and records a lien release bond, issued by a corporation authorized to issue surety bonds in Oregon, in an amount equal to one and one-half (1-1/2) times the amount of the claim of lien, and provides for the payment of any sum that the claimant may recover on the claim (including, without limitation, costs of suit, if the claimant should recover those in the action).
Costs and Liens. All inspection fees, appraisal fees, engineering fees and all other costs and expenses of any kind incurred by Buyer relating to the inspection of the Property shall be solely Buyer's expense and Buyer shall promptly remove, by payment, bonding or otherwise, any lien, claim of lien or notice of lien on the Property that results from Buyer's inspections.

Except for the Carve-Out, the Superpriority Claims of the Administrative Agent and the Lenders hereunder shall at all times be senior to the rights of the Borrowers, any chapter 11 trustee and any chapter 7 trustee, or any creditor (including, without limitation, post-petition counterparties and other post-petition creditors) in the Cases or any subsequent proceedings under the Bankruptcy Code, including, without limitation, any chapter 7 cases if any of the Borrowers’ Cases are converted to cases under chapter 7 of the Bankruptcy Code.

  • Bills and Liens Contractor shall pay promptly all indebtedness for labor, materials and equipment used in performance of the Work. Contractor shall not permit any lien or charge to attach to the Work or the premises, but if any does so attach, Contractor shall promptly procure its release and, in accordance with the requirements of Article 22 above, indemnify, defend, and hold County harmless and be responsible for payment of all costs, damages, penalties and expenses related to or arising from or related thereto.
