Common use of Controlled Group Member Clause in Contracts

Controlled Group Member. “Controlled Group Member” shall mean each trade or business (whether or not incorporated) which together with the Company would be treated as a “single employer” within the meaning of Code § 414(b), (c), (m), or (o), and includes all “leased employees” attributable to that single employer under Code § 414(n) or (o).

Controlled Group Member. “Controlled Group Member” shall mean group member means the Employer and each trade or business member of a controlled group of corporations (whether or not incorporatedas defined in section 414(b) which together with and as modified by Code section 415(h) of the Company would be treated as a “single employer” within the meaning of Code § 414(bCode), all commonly controlled trades or businesses (c), as defined in section 414(c) and as modified by Code section 415(h) of the Code) and affiliated service groups (m), or (o), and includes all “leased employees” attributable to that single employer under Code § 414(nas defined in section 414(m) or (o)of the Code) of which the Employer is a part.
