Common use of Contractual Obligations Clause in Contracts

Contractual Obligations. Other than the Loan Documents, the organizational documents of Borrower (and the initial membership interests in Borrower issued pursuant thereto) and Owner, neither Borrower nor any of its assets shall be subject to any Contractual Obligations, and Borrower shall not enter into any agreement, instrument or undertaking by which it or its assets are bound, except for such liabilities, not material in the aggregate, that are incidental to its activities as a regular member of Owner.

Contractual Obligations. Other than the Loan Documents, Documents and the organizational documents of Borrower the Mortgage Borrowers (and the initial membership limited liability company interests in Borrower Mortgage Borrowers issued pursuant thereto) and Owner), neither Borrower nor any of its assets shall be subject to any Contractual Obligations, and no Borrower shall not enter into any agreement, instrument or undertaking by which it or its assets are bound, except for such liabilities, not material in the aggregate, that are incidental to its activities as a regular member of Ownerthe applicable Mortgage Borrower.
