The Broker shall disclose to tenant the location of the security deposit account as required by Del. Law § 5513 (a).

Manager may perform any of Manager’s duties through attorneys, agents, employees, and independent contractors, and shall not be responsible for their acts, omissions, defaults, negligence, and/or costs of same, except for employees of Manager acting within the scope of their employment for Manager (pursuant to applicable law). Manager may perform any of its duties, and obtain necessary products and services, through affiliated companies or organizations in which Manager may own an interest, and may receive fees, commissions, and/or profits from these affiliated companies or organizations. Manager agrees that if it uses any company that it owns an interest that the fees charged for any services provided to Owner shall be within fair market rates. Manager may receive fees, commissions, or profits from unaffiliated companies in the performance of this PMA without prior disclosure to Owner. Manager will provide copies of vendor invoices only upon written request from Owner, which shall be subject to the “Records” fee and costs.
