CONTRACT WAIVERS. 4.16.1 School site improvement, restructuring or reform plans shall not contain any provisions contrary to, or in conflict with any article or section of this Agreement, unless specific waivers to such Agreement articles and sections are agreed to by the Association and the District.
CONTRACT WAIVERS. Recognizing that education reform activity may require collective bargaining flexibility on a continuing basis, the District and the Association adopt the following guidelines to assist in the implementation of the joint commitment.
CONTRACT WAIVERS. Any school leadership team that desires to waive a portion or section of this collective bargaining agreement shall first meet with the MCEA President or his/her designee and the appropriate Associate Superintendent from the Office of School Support and Improvement to discuss what the interest is in requesting such a waiver . Following this meeting, if the leadership team is still interested in pursuing a waiver, it is expected to follow an interest-based decision-making process to discuss the waiver request: ■ The issue should first be clearly articulated ■ The interests of the parties should be discussed ■ Those interests that are shared should be identified ■ The team should discuss different options and determine which options address the issue and meet the shared interests ■ The team should determine if they can reach agreement on one option, and if they can, they should communicate this waiver request to the other unit members in the school and share their intent to submit the request to the LMCC . The LMCC will ask representatives of the school leadership team to present their request at a LMCC meeting and describe why they believe it should be approved, the process that was followed, the interests that are being addressed, and the other options that were considered . The LMCC will de- liberate following this presentation and may either make a decision at the time or request additional information so that the decision can be made at the following LMCC meeting . The waiver will be reviewed annually by the LMCC . Waiver requests that involve contract waivers for more than just the MCEA bargaining unit will be referred to the Associations/ Deputies/Chief Operating Officer (ADC) Committee for review and decision .
CONTRACT WAIVERS. The Association and the District recognize that the pursuance of best practices may result in the seeking of waivers to the collective bargaining agreement. The Association shall determine if a waiver will go forward for a vote. Waiver proposals must include the purpose, impact on instructional program, impact on teachers, and/or the specific contract language or practice that is to be waived. Waivers to this contract will be granted when a vote conducted through secret ballot by the Association, shows seventy percent (70%) of the site members participating in the vote support the proposed waiver. Such waivers are granted for one year subject to an annual review, resubmittal and succeeding votes.
CONTRACT WAIVERS. ‌ Either Employees or administrators may request that the District and the Association waive requirements of this Contract. Waiver proposals must be developed with knowledge and opportunity for the participation of all Employees and administrators assigned to the building/program submitting the proposal. The waiver request must be submitted to the Superintendent or designee and the Association concurrently, and will be granted only if both the District and Association agree. See also Section 6.11 and Appendices E and F for forms.

The waiver request must be submitted to the Deputy Superintendent of Schools or designee and the Association no later than the last Friday of February for approval, absent any other deadline. Waivers may be granted only if both the District and Association agree. Renton Innovation Zone (RIZ) Waiver Requests, to leave or join RIZ, must be completed and one copy submitted to the Deputy of Schools and one copy to the REA Office no later than the last Friday of February for approval.
