Common use of Consultant’s Status Clause in Contracts

Consultant’s Status. 4.6.1. Consultant shall perform all Services as an independent contractor. Although Owner reserves the right to set the delivery schedule for the Services to be performed and to evaluate the quality of the completed performance, Owner cannot and will not control the means and manner of Consultant’s performance. Consultant is responsible for determining the appropriate means and manner of performing the Services. Consultant, Consultant’s employees and the Sub-consultants are not “officers, employees, or agents” of the State of Oregon or Owner, as those terms are used in ORS 30.265.
