Constructive Notice. Every person or entity who now or hereafter owns or acquires any right, title or interest in or to any portion of the Project or the Property is and shall be constructively deemed to have consented and agreed to every provision contained herein, whether or not any reference to this Agreement is contained in the instrument by which such person acquired an interest in the Project or the Property.

Every person or entity who now or hereafter owns or acquires any right, title or interest in or to any portion of the Project Site and undertakes any development activities at the Project Site, is, and shall be, constructively deemed to have consented and agreed to, and is obligated by all of the terms and conditions of this Agreement, whether or not any reference to this Agreement is contained in the instrument by which such person acquired an interest in the Project Site.
Constructive Notice. Every person, who by operation of law, transfer or other means whatsoever, becomes entitled to any share, shall be bound by every notice in respect of such share which, previously to his or her name and address being entered on the Register, has been duly given to the person from whom he or she derives his or her title and to every previous holder thereof.

Constructive Notice. Any deficiencies as to direct notice to the individual for the matching program are cured by the indirect or constructive notice that is afforded the individual by agency publication in the Federal Register of both the (1) applicable routine use notice, as required by subsection (e)(11) of the Privacy Act, permitting disclosures of data and (2) the proposed match notice, as required by subsection (e)(12) of the Privacy Act, announcing the agency’s intent to conduct computer matching for purposes of determining eligibility for Xxxxxxxxxx GI Xxxx and Post- 9/11 GI Xxxx benefits.
Constructive Notice. Any deficiencies in providing direct notice of the matching program to affected individuals as provided in paragraph A above are ameliorated by the indirect or constructive notice afforded to record subjects by (1) DoD’s publication in the Federal Register of the routine use in the applicable DMDC SORN, as required by subsection (e)(11) of the Privacy Act, and (2) the publication of the matching notice as required by subsection (e)(12) of the Privacy Act, announcing this matching program.

Every person or entity who now or hereafter owns or acquires any right, title or interest in or to any portion of the Project or the Project Site and undertakes any development activities at the Project Site is, and shall be, constructively deemed to have consented and agreed to, and is obligated by, all of the terms and conditions of this Agreement, whether or not any reference to this Agreement is contained in the instrument by which such person acquired an interest in the Project or the Project Site.
Constructive Notice. VA will publish notice of the matching program in the FR as required by the Privacy Act (5 U.S.C. § 552a(e)(12)).

A. are cured by the indirect or constructive notice that is afforded record subjects by agency publication in the Federal Register of both the (1) DMDC routine use notice, as required by subsection (e) (11) of the Privacy Act, permitting disclosures of Federal personnel information to ACF/SPAAs and (2) the proposed match notice, as required by subsection (e) (12) of the Privacy Act, announcing the agency's intent to conduct computer matching for purposes of determining an individual's continued eligibility for public assistance under Federal benefit programs being administered by the States.
Constructive Notice. Any deficiencies as to direct notice procedures to the individual for the matching program in paragraph VII (A), above, are cured by the constructive or indirect notice that will be accorded record subjects by agency publication in the FR of both the applicable routine use in the relevant system of records notice, as required by subsection (e)(11) of the Privacy Act, permitting disclosures of information for purposes of verifying eligibility for continued receipt of disability compensation or pension and the proposed matching program notice, as required by subsection (e)(12) of the Privacy Act, announcing the agency's intent to conduct computer matching for verification of eligibility for disability compensation or pension.
