CONSTRUCTION LICENSE. 3.17.1 The Owner hereby provides to the Contractor a non-exclusive license to have access to and to use the Place of the Work sufficient to allow the Contractor to perform the Work.
CONSTRUCTION LICENSE. The lease by Lessor to Lessee of the Facility 2 Property under this Agreement is granted to Lessee reserving to Lessor and its agents a temporary construction license to enter upon the Facility 2 Property for purposes of constructing the New Improvements. CONSTRUCTION LICENSE. The successful bidder must possess at all times, at minimum, a valid California Class A license or a combination of California Class C licenses which constitutes a majority of the work.
CONSTRUCTION LICENSE. 43. If any excavation shall be made upon land adjacent to the leased premises, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, license to enter upon the leased premises for the purpose of doing such work as Landlord shall deem necessary to preserve the wall of the building of which the leased premises form a part from injury or damage and to support the same by proper foundations, without any claim for damages of indemnification against Landlord for diminution or abatement of rent.
CONSTRUCTION LICENSE. Tenant hereby grants in favor of Landlord and the Developer the license to go upon the Demised Premises in order to perform the Landlord’s Work (the “Right of Entry”) in accordance with the terms and conditions of this Amendment.
CONSTRUCTION LICENSE. The City and its sub licensees will have the temporary license to enter upon and use the Stonegate Tract to engage in necessary activities connected with the construction of the Improvements. This construction license will automatically terminate thirty (30) days after completion of the Improvements, without the need for the execution of any further authorization, consent or other documentation to evidence such termination.
CONSTRUCTION LICENSE. 3.17.1 The Owner hereby provides to the Contractor a non-exclusive license to have access to and to use the Place of Work sufficient to allow the Contractor to perform the Work. The extent of this license shall be as set out in the Contract Documents and as otherwise directed by the Consultant. The Contractor agrees to provide hoarding around the licensed area outside of the existing Hospital building in accordance with the Contract Documents and also agrees to cordon off areas within the existing Hospital building within which the Contractor is performing the Work as required under the Contract Documents and as approved by the Consultant and further agrees to use such access to the existing Hospital building including loading docks and freight elevators and access routes as provided in the Contract Documents and as otherwise directed by the Consultant.
CONSTRUCTION LICENSE. During the Construction License Term, Purchaser grants Seller and Seller’s contractors and subcontractors a non-exclusive license to use an area of the Premises to be designated by the Purchaser and reasonably acceptable to Seller exclusively as a laydown and construction staging area and for temporary storage (the “Construction License”). Notwithstanding Purchaser’s grant of the License, all of Seller’s construction-related activities must be confined to the area granted in the Construction License. Purchaser shall have no liability whatsoever in connection with property or equipment located in the area of the Construction License, excluding damage caused by the gross negligence or intentional misconduct of any Purchaser Party, and Seller shall indemnify Purchaser for any and all claims arising from the maintenance of such property or equipment; provided, Seller shall not be obligated to indemnify Purchaser for any loss, liability or claims arising out of the gross negligence or intentional misconduct of any Purchaser Party.
CONSTRUCTION LICENSE. Provided Buyer has delivered the Second Deposit, Seller shall, in good faith, in its sole discretion, approve Buyer’s request to enter into a Construction License and Indemnity Agreement (the “License Agreement”) in such form as may be mutually acceptable to Buyer and Seller. Buyer’s indemnity obligations, and other obligations under the License Agreement which state that they so survive, shall survive the termination of this Agreement.
