Xxxxxx, as trustee, for the benefit of Lender, as beneficiary, dated of even date herewith securing the payment of the Notes, and the payment and performance of all obligations specified in the Construction Deed of Trust and the Loan Documents, and evidencing a valid and enforceable lien on and direct assignment of the Property.
