Construction Allowances. As contribution to Tenant's construction of Tenant's Expansion Improvements, Landlord agrees to provide Tenant with a tenant improvement allowance in the amount equal to Fifty-Five and No/100 Dollars ($55.00) per usable square foot of floor area of the Expansion Premises (the Expansion Premises is estimated to have 37,517 usable square feet), which equates to a sum of $2,063,435.00 (hereafter, the "Expansion Construction Allowance"), together with a separate and additional fixed sum in an amount equal to Ninety-Three Thousand Dollars ($93,000) in connection with Tenant' s installation of a variable refrigerant HVAC system exclusively serving the Expansion Premises (the "HVAC Allowance") as part of Tenant's Work (defined in Exhibit C), which HVAC system shall remain at the Expansion Premises following Tenant's surrender of the Expansion Premises at the expiration or earlier termination of the Expansion Tenn. The Expansion Construction Allowance and the HVAC Allowance shall be paid to Tenant in accordance with the requirements and procedures set forth in Section 3.03 of Exhibit C attached hereto and incorporated by reference.
Construction Allowances. Landlord shall provide Tenant with a construction allowance to be used for the construction of the Improvements set forth in the Plans attached hereto as Exhibit B in accordance with Article 10. The amount of the allowance (the "Allowance") shall be equal to the lesser of (i) $508,500.00 or (ii) the total cost of the Improvements as evidenced by invoices therefor. Landlord shall make direct payment of the Allowance to the contractors performing the Improvements. Tenant shall be liable for all charges in excess of $508,500.00. Landlord shall, at Tenant's expense (but Tenant may use part of the Allowance towards this expense) be required to obtain all necessary governmental permits and certificates for the commencement and prosecution of the Improvements and should cause the Improvements to be made and installed in compliance therewith, as well as with all applicable laws and requirements of public authorities and all applicable insurance requirements, in a good and workmanlike manner using materials and equipment as specified in the Plans attached hereto as Exhibit B.
Construction Allowances. Responsibility for construction allowances and other tenant inducements and for leasing commissions shall be allocated as provided in Section 8.1.
