Common use of Construction Agreement Clause in Contracts

Construction Agreement. Borrower and Contractor have entered into the Construction Agreement pursuant to the terms and conditions of which Contractor is to construct the Improvements. Borrower shall require Contractor to perform in accordance with the terms of the Construction Agreement and shall not amend, modify or alter the Construction Agreement without Lender's prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed. Borrower shall execute, upon Lender's request, an assignment of Borrower's rights under the Construction Agreement to Lender as security for Borrower's obligations under this Agreement and the other Loan Documents and shall cause the Contractor to consent to any such assignment.

Construction Agreement. Borrower and Contractor have entered into the Construction Agreement pursuant to the terms and conditions of which Contractor is to construct rehabilitate the Improvements. Borrower shall require Contractor to perform in accordance with the terms of the Construction Agreement and shall not materially amend, modify or alter the responsibilities of Contractor under the Construction Agreement without Lender's Bondowner Representative’s prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed. Borrower shall execute, upon Lender's Bondowner Representative’s request, an assignment of Borrower's ’s rights under the Construction Agreement to Lender Bondowner Representative as security for Borrower's ’s obligations under this Loan Agreement and the other Loan Documents and shall cause the Contractor to consent to any such assignment.

Borrower shall execute, upon Lender's ’s request, an assignment of Borrower's ’s rights under the Construction Agreement to Lender as security for Borrower's ’s obligations under this Agreement and the other Loan Documents and shall cause the Contractor to consent to any such assignment.

Borrower shall require Contractor to perform in accordance with the terms of the Construction Agreement in a material manner and shall not amend, modify or alter the responsibilities of Contractor under the Construction Agreement without Lender's Administrative Agent’s prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed. Borrower shall execute, upon Lender's Administrative Agent’s request, an assignment of Borrower's ’s rights under the Construction Agreement to Lender Administrative Agent, for the benefit of Lenders as security for Borrower's ’s obligations under this Agreement and the other Loan Documents and shall cause the Contractor to consent to any such assignment.

Borrower shall execute, upon Lender's Bondowner Representative’s request, an assignment of Borrower's Xxxxxxxx’s rights under the Construction Agreement to Lender Bondowner Representative as security for Borrower's ’s obligations under this Loan Agreement and the other Loan Documents and shall cause the Contractor to consent to any such assignment.

Borrower and Contractor have entered a general contractor approved by Lender ("Contractor") will enter into the a construction agreement ("Construction Agreement Agreement"), pursuant to the terms and conditions of which Contractor is to will construct the ImprovementsImprovements in accordance with the Plans and Specifications. Borrower shall require Contractor to perform in accordance with the terms of the Construction Agreement and shall not amend, modify or alter terminate the duties of Contractor under the Construction Agreement without Lender's prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed. Borrower shall execute, upon Upon Lender's request, Borrower shall execute an assignment of Borrower's rights under the Construction Agreement to Lender as security for Borrower's obligations under this Agreement and the other Loan Documents and shall cause the Contractor to consent to any such assignment.
