Conflicts; Ratification. To the extent that any provisions of this Amendment are inconsistent with the terms of the Agreement, this Amendment will constitute an amendment to the Agreement pursuant to Section 11.16
Conflicts; Ratification. In the event that there is a conflict between the provisions of this Amendment and the Employment Agreement as to the matters addressed herein, the terms stated in this Amendment shall prevail. Any terms and conditions stated in the Employment Agreement that are not expressly modified by this Amendment remain unchanged and shall remain in full force and effect. All references to the “this Agreement” in the Employment Agreement shall mean the Employment Agreement, as amended hereby.
Conflicts; Ratification. In the event of any conflict between the terms of this Amendment and the terms of the Agreement, the terms of this Amendment shall supersede and control. Except as herein modified, all terms and conditions of the Agreement are incorporated herein and shall remain in full force and effect, and are hereby ratified and confirmed by the University and Licensee.
Conflicts; Ratification. In the event of a conflict or inconsistency between the provisions of this Amendment and the Note, the provisions of this Amendment shall control and govern. As amended by this Amendment, the Note is ratified and remains in full force and effect in accordance with its terms.
Conflicts; Ratification. This First Addendum shall control over any conflicting provisions of the Original Agreement and shall constitute an amendment thereto to the extent of any such conflict. Except as amended by this First Addendum, all terms and provisions of the Original Agreement shall remain in full force and effect without modification. The parties hereby ratify and confirm the terms and provisions of the Original Agreement as amended hereby. For point of clarification only, and not by way of limitation, the Renewal Option provisions set forth in paragraph 11 of the Original Agreement shall continue to be applicable for the term of this First Addendum.
Conflicts; Ratification. In the event of any conflict between the terms of this Fourth Amendment and the terms of the Lease, the terms of this Fourth Amendment shall control. The Lease, as amended by this Fourth Amendment, is hereby ratified and affirmed.
Conflicts; Ratification. In the event that there is a conflict between the provisions of this Amendment and the Merger Agreement as to the matters addressed herein, the terms stated in this Amendment shall prevail. Any terms and conditions stated in the Merger Agreement that are not expressly modified by this Amendment remain unchanged and shall remain in full force and effect.
Conflicts; Ratification. In the event of any conflict between the terms of this Third Amendment and the terms of the Lease, the terms of this Third Amendment shall control. The Lease, as amended by this Third Amendment, is hereby ratified and affirmed.
Conflicts; Ratification. In the event of a conflict between the terms of this Amendment and the terms of the Contribution Agreement, this Amendment shall control. Except as amended herein, all other terms of the Contribution Agreement are ratified and confirmed.
Conflicts; Ratification. The Memorandum as modified hereby is not intended to amend or modify the terms and conditions of the Lease, as amended by the First Amendment. If there is a conflict between the provisions of the Memorandum as modified hereby and the provisions of the Lease, as amended by the First Amendment, the provisions of the Lease, as amended by the First Amendment shall govern and control.
