Common use of Confidential Business Information Clause in Contracts

Confidential Business Information. The Government acknowledges that the recipient or its subcontractors may provide to DOE confidential or proprietary business, technical or financial information. XXX will manage this information consistent with the Trade Secrets Act, 18 U.S.C. §1905. DOE will also process any request for release of this information to the public consistent with the Freedom of Information Act (FOIA), 5 U.S.C. §552 and DOE’s FOIA regulations, 10 C.F.R Part 1004. XXX agrees that any confidential business, financial, and legal information provided by the recipient is not "data" within the meaning of the Rights in Data clause.
