CONCERNING THE BORROWER. The term "Borrower" as used herein shall mean and include the undersigned as trustees of the Trust and their successors in trust not individually but solely as Trustees under that certain Aasche Transportation Services, Inc. Employees' Stock Ownership Trust dated effective as of September 22, 1994, between the undersigned and the Parent Company, and this Agreement shall be binding upon the undersigned and their successors and assigns and upon the trust estate. Subject to Section 10.13 hereof, the undersigned assume no personal liability or responsibility for payment of the indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in their capacity as trustees as aforesaid to bind the undersigned, their successors in trust and the trust estate.
CONCERNING THE BORROWER. The term "Borrower" as used herein shall mean and include the undersigned as Trustee of the Trust and its successors in trust not individually but solely as Trustee under that certain Security Savings Association Employee Stock Ownership Plan Trust effective _____________, 1998, by and between the undersigned and Security Savings Association of Hazleton and this Agreement shall be binding upon the undersigned and its successors and assigns and upon the trust estate. The undersigned assumes no personal or individual liability or responsibility for payment of the indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in its capacity as Trustee as aforesaid to bind the undersigned, its successors in trust and the trust estates.

The undersigned assumes no personal or individual liability or responsibility for payment of the indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in its capacity as trustee as aforesaid to bind the undersigned, its successors in trust and the trust estates.

The undersigned assumes no personal or individual liability or responsibility for payment of the indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in its capacity as trustee as aforesaid to bind the undersigned, its successors in trust and the trust estates.

The undersigned assumes no personal or individual liability or responsibility for payment of the indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in its capacity as Trustee as aforesaid to bind the undersigned, its successors in trust and the trust estates.

The term "Borrower" as used herein ----------------------- shall mean and include the undersigned as Trustee of the Trust and its successors in trust not individually but solely as Trustee under that certain West Essex Bank Employee Stock Ownership Plan Trust effective January 16, 1998, by and between the undersigned and West Essex Bank and this Agreement shall be binding upon the undersigned and its successors and assigns and upon the trust estate. The undersigned assumes no personal or individual liability or responsibility for payment of the indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in its capacity as Trustee as aforesaid to bind the undersigned, its successors in trust and the trust estates.

The term "Borrower" as used herein shall ----------------------- mean and include the undersigned as Trustee of the Trust and its successors in trust not individually but solely at Trustee under that certain Richmond county Savings Bank Employee Stock Ownership Trust effective __________________, by and between the undersigned and Richmond County Savings Bank and this Agreement shall be binding upon the understanding and its successors and assigns and upon the trust estate. The undersigned assumes no personal or individual liability or responsibility for payment of the indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in its capacity as trustee as aforesaid to bind the undersigned, its successors in trust and the trust estates.

The term "Borrower" as used herein shall mean and include the undersigned as Trustee of the Trust and its successors in trust, not individually but solely as Trustee under that certain agreement forming the Trust. The undersigned Trustee assumes no personal or individual liability or responsibility for payment of the -indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in its capacity as trustee as aforesaid to bind the undersigned. its successors in trust and the trust estates.
CONCERNING THE BORROWER. The term "Borrower" as used herein shall mean and include the undersigned as trustee of the Trust and their successes in trust not individually but solely as Trustee under that certain Astoria Federal Savings and Loan Association Employee Stock Ownership Trust effective November 18, 1993, by and between the undersigned and Astoria Federal Savings and Loan Association and this Agreement shall be binding upon the undersigned and its successes and assigns and upon the trust estate. The undersigned assumes no personal or individual liability or responsibility for payment of the indebtedness evidenced by the Note or for observance or performance of the covenants and agreements herein contained or for the truthfulness of the representations and warranties herein contained, the undersigned having executed this Agreement and the Note solely in its capacity as trustee as aforesaid to bind the undersigned, its successes in trust and the trust estates.
CONCERNING THE BORROWER. The Borrower shall: deliver to the Bank: with respect to each fiscal year, within 1 (one) month after the approval of the state budget for such fiscal year, a summary of such state budget in tabular form (responsible authority – the Ministry of Finance); the audited Project Accounts and auditor’s reports within 6 (six) months from the end of each fiscal year; any such information or further documents concerning customer due diligence matters of or for the Borrower as the Bank may reasonably require within a reasonable time; and from time to time, such further information on its general financial situation as the Bank may reasonably require; and inform the Bank immediately of: any fact which obliges it to prepay any financial indebtedness or any European Union funding; any event or decision that constitutes or may result in a Prepayment Event; any intention on its part to grant any Security over any of its assets in favour of a third party; any fact or event that is reasonably likely to prevent the substantial fulfilment of any obligation of the Borrower under this Contract; any Event of Default having occurred or being threatened or anticipated; any litigation, arbitration or administrative proceedings or investigation which is current, threatened or pending and which might if adversely determined result in a Material Adverse Change.
