Compliance with Schedule. WFI shall commence the Services as soon as ------------------------- practicable after receipt of the Notice to Proceed. WFI shall carry on and complete the Services in accordance with the Project Schedule as amended in accordance with Article IV.
Compliance with Schedule. Time is of the essence of this Agreement. The Subcontractor shall commence work upon receiving notice to proceed from the Contractor and shall prosecute the Work in a manner that will not delay the completion of the Owner/Contractor Contract. If, within 24-hours of receiving notice, the Subcontractor fails to comply with schedule requirements, then the Contractor may elect to complete all or part of the Subcontractor's Work and charge the related costs to the Subcontractor. The Subcontractor shall work in accordance with any schedule established by the Contractor, including any updated or modified schedules. The Subcontractor shall assist the Contractor in developing schedules and monthly updates by providing all relevant information concerning or affecting its progress, including the duration and sequence of its activities, and by cooperating in the coordination of its Work with that of other subcontractors.
Compliance with Schedule. Contractor shall perform the Work in strict accordance with the Schedule submitted to and accepted by Authority. Contractor shall have the sole and exclusive responsibility for completing the Work according to the Schedule. Failure to materially comply with the Schedule shall be considered a breach of this Agreement. Any proposed revisions to the Schedule which would affect Contract Time shall be submitted by Contractor pursuant to the Change Order procedure set forth in Section 2.11 of this Agreement. If Authority reasonably determines that the performance of the Work has not materially reached the level of completion set forth in the Schedule or the Contract Documents (taking into account any corrective schedule action(s) proposed by Contractor including, but not limited to, resequencing tasks or lags to obtain compliance with the Schedule), then Authority shall have the right to require Contractor to take all measures necessary to expedite the Work in order to materially comply with the Schedule including, but not limited to, working additional shifts or overtime, supplying additional labor, equipment, facilities, and other similar measures. Authority's right to require such measures is solely for the purpose of ensuring Contractor's compliance with the Schedule. Contractor shall not be entitled to an adjustment in the Contract Sum in connection with such measures required by Authority. Authority may exercise the rights furnished in this Section 2.9(a) as frequently as Authority deems necessary to ensure that Contractor's performance of the Work will comply with the Contract Time.
Compliance with Schedule. 9 You must, in respect of the Generating Facilities and associated works, at all times comply with your obligations under Generator Performance Standards, Generator Technical Requirements and other provisions of Schedule 5.
Compliance with Schedule. Borrower shall diligently perform the Initial Construction Work using all commercially reasonable efforts in accordance with the Initial Construction Schedule. Borrower, from time to time, may modify or adjust individual line items within the Initial Construction Schedule to reflect actual and projected conditions but in no event extend or delay the completion dates for the following milestones without Lender’s written approval.
Compliance with Schedule. 1: The Issuer will comply with the relevant restrictions set out in Schedule 1 hereto as if it were the Managers under this Agreement;
Compliance with Schedule. “A” The Alteration is in compliance with the provisions of Schedule “A” attached to and forming part of this Agreement which govern the specifications for the Alteration that has been made.
Compliance with Schedule. 3.1 The Parties agree to comply with and abide by the terms and conditions set out in Schedule A to this Agreement. The Service Manager agrees to administer the Pilot in accordance with Schedule A.
Compliance with Schedule. Subject to Force Majeure delays, Borrower shall diligently perform the development, design and Construction using all commercially reasonable efforts in accordance with the Development Schedule, and each portion thereof.
Compliance with Schedule. 98. The Class Distribution Fund for payments to the class shall not accrue further inter- est payable to Qualifying Class Members beyond the specified amount of the Fund, provided, how- ever, except for good cause shown, in the event the disbursements to the Qualifying Class Members are not made by the deadline in ¶94 above, due to the County’s delay in performing its require- ments under this Agreement, which delay was not due to delay by the Processing Office or class counsel, interest shall accrue from that date at 12% per annum on the undistributed amounts of the Fund (see Part VII above for Fund amount) and such interest shall be added pro rata to the amounts to be disbursed to the Qualifying Class Members.
