Complete Mortgage Files. The instruments and documents specified in Section 2.02 with respect to such Mortgage Loan have been delivered to the Purchaser in compliance with the requirements of Article II. The Seller is in possession of a Mortgage File respecting such Mortgage Loan, except for such documents as have been previously delivered to the Purchaser;
Complete Mortgage Files. The Mortgage Note, the Mortgage, the Assignment of Mortgage and the other Mortgage Loan Documents set forth in Exhibits 1 and 2 and required to be delivered on the related Closing Date have been delivered to the Purchaser or its designee in compliance with the specific requirements of this Agreement and the PPTL for the related Mortgage Loan Package. With respect to each Mortgage Loan, the Seller is in possession of a complete Mortgage File including all documents used in the qualification of the borrower except for such documents as have been delivered to the Purchaser or its designee. In the event the Mortgage is a deed of trust, a trustee, authorized and duly qualified under applicable law to serve as such, has been properly designated, is named in the Mortgage and currently so serves, and no fees or expenses are or will become payable by the Purchaser to the trustee under the deed of trust, except in connection with a trustee's sale after default by the borrower.
Complete Mortgage Files. The Mortgage Note, the Mortgage, the Assignment of Mortgage and the other Mortgage Loan Documents set forth in Exhibits 1 and 2 and required to be delivered on the related Closing Date have been delivered to the Purchaser or its designee in compliance with the specific requirements of this Agreement. PHH is in possession of a Mortgage File respecting such Mortgage Loan, except for such documents as have been previously delivered to the Custodian;
Complete Mortgage Files. The instruments and documents specified in Section 2.02 with respect to such Mortgage Loan have been delivered to the Purchaser in compliance with the requirements of Article II. The Seller is in possession of a Mortgage File respecting such Mortgage Loan, except for such documents as have been previously delivered to the Purchaser or its Custodian. All documents required to be included in the Mortgage File shall be complete, executed as required and in compliance with applicable law. With respect to each Mortgage Loan for which a lost note affidavit has been delivered to the Custodian in place of the original Mortgage Note, if such Mortgage Loan is subsequently in default, the enforcement of such Mortgage Loan or of the related Mortgage by or on behalf of the Purchaser will not be affected by the absence of the original Mortgage Note;
Complete Mortgage Files. The instruments and documents specified in Section 2.02 of the Transfer Agreement with respect to such Revolving Credit Loan have been delivered to the Purchaser in compliance with the requirements of Article II of the Transfer Agreement. The Seller is in possession of a Mortgage File respecting such Revolving Credit Loan, except for such documents as have been previously delivered to the Purchaser and all documents required hereunder to be delivered to Purchaser after the Purchase Date will be so delivered by Seller within the time specified herein for such delivery;
Complete Mortgage Files. Except as provided in Section 2.07, the Mortgage Note, the Mortgage, the Assignment of Mortgage and the other documents set forth in Exhibit A-1 and required to be delivered on the related Closing Date have been delivered to Purchaser or its designee. With respect to each Mortgage Loan, Seller is in possession of a complete Mortgage File including all documents used in the qualification of the Mortgagor except for such documents as have been delivered to Purchaser or its designee.
Complete Mortgage Files. The Mortgage Note, the Mortgage, the Assignment of Mortgage (except with respect to MERS Designated Mortgage Loans) and the other Mortgage Loan Documents set forth in Exhibit A-1 and A-2 hereto required to be delivered on or before the related Closing Date have been delivered to the Purchaser or its designee in compliance with the specific requirements of this Agreement. With respect to each Mortgage Loan, the Servicer is in possession of a complete Mortgage File including all documents used in the qualification of the borrower, except for such documents as have been delivered to the Purchaser or its designee;
Complete Mortgage Files. The instruments and documents specified in Section 2.01 with respect to such Cendant Mortgage Loan have been delivered to DLJMC or its designee in compliance with the requirements of Article II. Cendant is in possession of a Mortgage File respecting such Cendant Mortgage Loan, except for such documents as have been previously delivered to DLJMC or its designee;
Complete Mortgage Files. The Company is in possession of a Mortgage File respecting such Mortgage Loan, except for such documents as have been previously delivered to the Assignee;
