Compensatory Time Off (CTO). A. In lieu of the cash compensation for overtime provided by Section 1104, unit employees who work overtime may elect to accrue CTO provided, however, that should an employee elect to accrue CTO, the employee shall accrue only CTO hours equal to the number of overtime hours actually worked. The half-time premium for overtime hours worked shall be paid in cash at the Regular Rate of Pay.

Compensatory Time Off (CTO). 1. Employees working overtime will be eligible to accrue Compensatory Time Off (CTO) in lieu of receiving overtime compensation for each hour of overtime worked. CTO is earned at one and a half (1.5) hours for each hour worked. CTO may be accrued up to a maximum of forty (40) expanded hours.
Compensatory Time Off (CTO). Compensatory time off (CTO) shall not be confused with “flex-time”. Compensatory time strictly refers to an alternate form of compensation for overtime work and shall be paid at one and one half (1 ½) times the base hourly pay rate. Compensatory Time Off (CTO). Compensatory Time is defined to include any time worked in excess of eight (8) hours in any one (1) day or eight (8) hours on any (1) shift or in excess of forty (40) hours in any calendar week [except as identified in Section 5.1.1(a)(b)(c)]. When Overtime is authorized to be worked, the member has the choice between compensatory time off or cash compensation. The member’s choice to accumulate CTO in lieu of cash compensation shall be recorded on their overtime time card, which shall be tracked by the supervisor, the employee and the payroll department. The CTO balance shall appear on the employee’s pay stub along with vacation and sick leave balances. Compensatory time can accumulate to a maximum of 40 hours and shall be granted within the fiscal year without impairing the services rendered by the district. If, due to operational needs, it is found the CTO balance cannot be used within the fiscal year without impairing the services of the District, the member will be paid out their CTO time no later than August 31st of the following fiscal year. CTO use shall not be unreasonably denied. If advance notice is given by the member, lack of a substitute shall never be a reasonable justification for denying CTO use.

Time off shall be given for a period equal to the appropriate overtime rate. Although there is no monthly limit on the accrual of compensatory time off, BWP Managers shall not permit any employee to accumulate CTO in excess of 240 hours. Compensatory time off may be cashed out at any time and built back up without reprisal. By entering into this Agreement it is the intent of the Parties to comply with the Fair Labor Standards Act (FLSA) regarding the use of CTO as interpreted by the Ninth Circuit in the case of Xxxxxxxxx v County of Sacramento. Through this Agreement, the Parties have identified what they believe constitutes reasonable notice of a request to use CTO and the obligations of each employee and BWP when a request is made. However, because of the unpredictability of utility work, the Parties agree that BWP reserves the right to deny any request(s) to use CTO if, under the circumstances, the procedures identified below will not eliminate the “undue disruption” of the utility. Employees’ may request to use their compensatory time off in the same manner as vacation is scheduled. Use of compensatory time off shall be with the approval of BWP Managers. The Parties agree that BWP shall not be required to backfill a request to use CTO with another employee using overtime because backfilling defeats the cost savings associated with granting CTO and is unduly disruptive to the operation of the utility. Although the parties anticipate this will not happen, if the request to use CTO cannot be granted within six months after the request is made, the employee will receive the cash out value of the CTO he has requested to use.
Compensatory Time Off (CTO). Unit members shall have the option to elect to take compensatory time off in lieu of cash compensation for overtime work with the written approval of the supervisor. Such election shall be submitted in writing to the immediate supervisor within five (5) working days following the day the overtime is worked.
