Compensation for Local Traffic. 4.1 All Local Traffic shall be exchanged between the Parties on a Xxxx and Keep basis. Under a Xxxx and Keep compensation arrangement, each Party retains the revenues it receives from its End User customer, and neither Party pays the other Party for transport and termination of the local traffic that is subject to the Xxxx and Keep arrangement. The specific compensation terms and conditions set forth in this Section 4.1 are limited to the exchange of Local Traffic between the Parties.
Compensation for Local Traffic. 6.1.1 Local Traffic is defined as any telephone call that is originated by an end user of one Party and terminated to an end user of the other Party within a given LATA on that other Party's network, except for those calls that are originated or terminated through switched access arrangements as established by the ruling regulatory body. Additionally, Local Traffic includes any cross boundary North Carolina intrastate, interLATA or interstate, interLATA call between specific wire centers established as a local call by the ruling regulatory body. As further clarification, Local Traffic does not include calls that do not transmit information of the user's choosing. In any event, neither Party will pay reciprocal compensation to the other if the "traffic" to which such reciprocal compensation would otherwise apply was artificially generated or manufactured with the knowledge or consent of either Party, in whole or in part, for the primary purpose of creating an obligation on the part of the originating carrier to pay reciprocal compensation for such traffic.
