Common use of Compensation During Dispute Clause in Contracts

Compensation During Dispute. If a purported termination occurs during the Term, and such termination is disputed in accordance with subsection (b) of this Section 8, the Corporation shall continue to pay the Employee the full compensation in effect when the notice giving rise to the dispute was given (including, but not limited to, salary) and continue the Employee as a participant in all compensation, benefit and insurance plans in which the Employee was participating when the notice giving rise to the dispute was given, until the Date of Termination, determined in accordance with subsection (b) of this Section 8. Amounts paid under this Section 8(c) are in addition to all other amounts due under this Agreement and shall not be offset against or reduce any other amounts due under this Agreement.

Amounts paid under this Section 8(c) are in addition to all other amounts due under this Agreement and shall not be offset against or reduce any other amounts due under this Agreement.

If a purported termination occurs during the Term, and such termination is disputed in accordance with subsection (b) of this Section 87, the Corporation Company shall continue to pay the Employee Executive the full compensation in effect when the notice giving rise to the dispute was given (including, but not limited to, salaryBase Salary, if applicable) and continue the Employee Executive as a participant in all compensation, benefit and insurance plans in which the Employee Executive was participating when the notice giving rise to the dispute was given, until the Date of Termination, determined in accordance with subsection (b) of this Section 87. Amounts paid under this Section 8(c7(c) are in addition to all other amounts due under this Agreement and shall not be offset against or reduce any other amounts due under this Agreement.

If a purported termination occurs on or after a Change in Control and during the Contract Term, and such termination is disputed in accordance with subsection (b) of this Section 8, the Corporation Company shall continue to pay the Employee Executive the full compensation in effect when the notice giving rise to the dispute was given (including, but not limited to, salary) and continue the Employee Executive as a participant in all compensation, benefit and insurance plans in which the Employee Executive was participating when the notice giving rise to the dispute was given, until the Date of Termination, determined in accordance with subsection (b) of this Section 8. Amounts paid under this Section 8(c) are in addition to all other amounts due under this Agreement and shall not be offset against or reduce any other amounts due under this Agreement.

Compensation During Dispute. If a purported termination occurs --------------------------- following a Change in Control and during the Term, Term and such termination the Date of Termination is disputed extended in accordance with subsection (bSection 9(c) of this Section 8hereof, the Corporation Company shall continue to pay the Employee Executive the full compensation in effect when the notice giving rise to the dispute was given (including, but not limited to, salary) and continue the Employee Executive as a participant in all compensation, benefit and insurance plans in which the Employee Executive was participating when the notice giving rise to the dispute was given, until the Date of Termination, as determined in accordance with subsection (bSection 9(c) of this Section 8hereof. Amounts paid under this Section 8(c9(d) are in addition to all other amounts due under this Agreement (other than those due under Section 5(b) hereof) and shall not be offset against or reduce any other amounts due under this Agreement.

If a purported termination occurs on or after a Change in Control and during the Contract Term, and such termination is disputed in accordance with subsection (b) of this Section 87, the Corporation Company shall continue to pay the Employee Executive the full compensation in effect when the notice giving rise to the dispute was given (including, but not limited to, salary) and continue the Employee Executive as a participant in all compensation, benefit and insurance plans in which the Employee Executive was participating when the notice giving rise to the dispute was given, until the Date of Termination, determined in accordance with subsection (b) of this Section 87. Amounts paid under this Section 8(c7(c) are in addition to all other amounts due under this Agreement and shall not be offset against or reduce any other amounts due under this Agreement.

B. Amounts paid under this Section 8(c) are in addition to all other amounts due under this Agreement and shall not be offset against or reduce any other amounts due under this Agreement.

If a purported termination occurs during the Term, and such termination is disputed in accordance with subsection (b) of this Section 7, the Company shall pay the Executive, at the time specified in Section 8, the Corporation shall continue to pay the Employee the full compensation in effect when the notice giving rise to the dispute was given (including, but not limited to, salaryBase Salary) and shall continue the Employee Executive as a participant in all compensation, benefit and insurance plans in which the Employee Executive was participating when the notice giving rise to the dispute was given, until the Date of Termination, determined in accordance with subsection (b) of this Section 87. Amounts paid under this Section 8(c7(c) are in addition to all other amounts due under this Agreement and shall not be offset against or reduce any other amounts due under this Agreement.
