Common use of Company’s Release Clause in Contracts

Company’s Release. The Company, on its own behalf and on behalf of its predecessors, parents, subsidiaries, affiliates, members, general partners, limited partners, representatives and assigns, hereby generally releases and discharges the Executive and his heirs, assigns, executors, agents and representatives from any and all suits, causes of action, complaints, obligations, demands, common law or statutory claims of any kind, whether in law or in equity, direct or indirect, known or unknown, which they ever had or now have against the Executive arising out of or relating to his employment with the Company occurring up to and including the date of this Release. Notwithstanding any other provision of this Release, the Company does not waive or release any claims against the Executive based on or arising out of conduct or circumstances for which the Executive could have been terminated for Cause (as defined in the Employment Agreement).
