The Common Area Services clause defines the landlord's responsibility to maintain, repair, and operate shared spaces and facilities within a property, such as lobbies, hallways, parking lots, and restrooms. This clause typically outlines the types of services provided—like cleaning, landscaping, security, and utilities—and may specify how the costs for these services are allocated among tenants, often through additional charges or service fees. Its core practical function is to ensure that all tenants benefit from well-maintained common areas while clearly establishing how the associated expenses are managed and distributed, thereby preventing disputes and ensuring the smooth operation of shared facilities.
COMMON AREA SERVICES. “Common Area Services” costs shall include: cleaning of appurtenant streets, parking areas and service areas; replacement of exterior Iighting fixtures and bulbs; window washing; exterior pest extermination control; property management fees paid by Landlord (which shall not exceed 3% of the gross revenues of the Project); salary allocations for maintenance personnel; restriping of parking areas; re-surfacing of parking area; exterior water, cleaning and maintaining landscaped areas; maintenance costs other than those associated with Landlord’s duties as defined in Paragraph 9.1; and routine maintenance and inspection of fire protection systems as required by Landlord and/or governmental authorities. Landlord and Tenant expressly agree that all services to be performed by Landlord, including maintenance, repairs and property management of the Premises and the common area surrounding the Premises, exclusively involve the exercise of professional judgment by Landlord and Landlord’s agents. Notwithstanding anything in this Lease to the contrary, Insurance and Common Area Services costs shall not include any of the following:
COMMON AREA SERVICES. Landlord shall cause the Building Common Areas, including its public lobbies and special service areas, to be cleaned, lighted and heated or air-conditioned as Landlord in its judgment deems necessary.
COMMON AREA SERVICES. A. Common use lavatories (with cold and tempered domestic water) at locations provided for general use and as reasonably required in keeping with the first-class standards of the Building.
B. Central heat, ventilation and air conditioning in season, at such temperatures and in such amounts as are reasonably deemed by Landlord to be in keeping with the first-class standards of the Building, to the common areas of the Building. Such heating and air conditioning shall be furnished at all times; provided, however, that heat in the common areas shall be reduced to approximately 62 degrees F during other than Normal Business Hours during the heating season, and air conditioning in the common areas shall be reduced to approximately 78 degrees F during other than Normal Business Hours during the cooling season.
C. Electric lighting service for all public areas and special service areas of the Building in the manner and to the extent reasonably necessary in keeping with the first-class standards of the Building. Lighting in the common areas shall be reduced to 66% off full lighting capacity during other than Normal Business Hours.
D. All Building standard fluorescent bulb and ballast replacement, and all LED and incandescent bulb replacement, in public areas, public lavatories, and Building stairwells.
E. Landlord shall perform pest and vermin control inspections and preventative measures in the common areas of the Building and Property annually (or as otherwise determined in Landlord’s reasonable discretion based on similar practices in office and laboratory buildings in Watertown).
COMMON AREA SERVICES. Common Area Services" costs shall include without limitation the cost of electricity, water/sewer, gas, trash removal, fire sprinkler inspections and maintenance, exterior painting, water blasting, interior termite control and exterior pest control, window washing, HVAC filter replacements, landscaping, lawn sprinkler repairs and maintenance, parking lot, service area and appurtenant street cleaning, repair, repaving and striping, replacement and maintenance of exterior lighting fixtures and bulbs; courtesy patrol (if offered); property management fees paid by Landlord, including an allocation of such manager's property manager, maintenance technician and other personnel costs; Amortized Repairs, and maintenance costs other than those associated with Landlord's duties as defined in paragraph 16.
COMMON AREA SERVICES. Landlord will also maintain and keep lighted the Common Areas, which damage will be repaired by Landlord at Tenant's expense. Wherever heat generating machines or equipment are used in the Premises which affect the temperature otherwise maintained by the air conditioning system in other parts of the Building, Landlord reserves the right, but will have no obligation, to install supplementary air conditioning units in the Premises, and the cost thereof, including the cost of installation, and the cost of operation and maintenance thereof, will be paid by Tenant to Landlord within ten (10) days of receipt of an invoice therefor from Landlord.
