Committee Recommendation. The insurance committee will make a recommendation to the Board of Education on insurance programs. The committee shall be the Assistant Superintendent of Human Resources, the Assistant Superintendent for Business and Technology, the PHNEA president or his/her designee, one teacher per building appointed by the PHNEA president and a member of the support staff. The committee shall meet as often as necessary to monitor and review the insurance programs, sick leave, professional leave, E.A.P., and Early Retirement. The committee shall make recommendations to the Board of Education.

The Committee shall send its recommendation and a statement of the reasons therefor, including a description of any considerations that were expressed for and against the recommendation by members of the Committee during its deliberations, together with the Request, the supporting information, a report of how the members of the Committee voted on the recommendation, a report by the Funding Corporation concerning its position on the recommendation, and any other material information that was considered by the Committee, to all Banks and the Funding Corporation by a nationally recognized overnight delivery service within fourteen days after receiving the Request. If the Committee fails to act within such fourteen-day period, the Continued Access Request shall be deemed forwarded to all Banks entitled to vote thereon for their consideration. If the Committee has failed to act, the Funding Corporation shall send to all Banks, within two days following the deadline for Committee action, a report concerning the position of the Funding Corporation on the Continued Access Request.
Committee Recommendation. The Committee established above may recommend a change in plan design and/or policy, in which event the recommendation shall be transmitted to City Council for consideration for adoption. All parties to the committee agree that actions taken by the Employer to adopt and implement recommendations of the committee shall not be subject to the grievance procedure or any other avenue of appeal.
