Commitment of Resources. Provide sufficient Institutional resources to the best of its ability to ensure effective implementation and development of all sponsored and administered Programs in compliance with both Program and Institutional accreditation requirements.

Notwithstanding anything contained in this Lease Agreement to the contrary, in the event Lessee terminates this Lease Agreement or wrongfully rejects Equipment prior to the commencement of the Minimum Lease Term, Lessee shall be responsible for the payment to Lessor of: a) the costs incurred by Lessor for labor, materials and work executed up to Lessor’s receipt of written notice of termination; b) storage related charges attributable to failed delivery; c) rent for the Minimum Lease Term; and d) reasonable overhead and profit. All such charges will be billed on a lump sum basis unless other payment options are agreed by the Lessor.

Commitment of Resources. 3.1 The Clean Air Agency staff person assigned as a liaison to WSDOT shall remain a Clean Air Agency employee at all times. 3.2 The WSDOT project engineers and staff person assigned as a liaison to The Clean Air Agency shall remain WSDOT employees at all times. 3.3 The Clean Air Agency will provide funding for the training courses and materials. 3.4 WSDOT is responsible for preparing, printing and distributing the WSDOT environmental procedures manual containing the BMP for fugitive dust control language.

Commitment of Resources. Enbridge and EOSI agree to commit to Management, on a priority basis, sufficient resources in providing the Operational Services in order that Management may fulfill its responsibilities as the delegee of the power to manage and control the MLP. Notwithstanding anything herein to the contrary, Enbridge and EOSI shall continue to perform the Operational Services on behalf of and as agent for Management as long as Management is the delegee of the power to manage and control the MLP, or until such time as this Agreement is terminated pursuant to SECTION 7.1 of this Agreement.
