Commercial Product. “Commercial Product” shall mean Product supplied hereunder intended for commercial sale and/or human use.
Commercial Product anything that incorporates, is based on, utilizes or is developed from Project Results and is created by human or mechanical effort or by a natural process and that is capable of being sold, licensed, transferred or conveyed to another party or is capable of otherwise being Exploited or disposed of, whether in exchange for consideration or not, including without limitation any drug, chemical or biological compound, gene, nucleic acid or nucleic acid sequence, gene therapy, plant, machine, mechanical device, hardware, tool or computer program.
Commercial Product. The Engager must obtain the Artist's prior written authorization before the Artist's picture may be used in conjunction with the sale and/or promotion of a commercial product, and said authorization must specify the commercial product involved. If the Artist consents to the use of said Artist’s picture, as aforesaid, the Artist shall be paid not less than the amount as specified below for said use. Commercial Product. Commercial Product. The Snowflake Offerings, including all related software and, to the extent applicable the Snowflake Technology, for ultimate federal government end use is made available solely in accordance with the following: The U.S. Government hereby agrees that the Snowflake Offerings qualify as “commercial products” as defined by FAR Part 2.101 or the state law corollary. The terms and conditions of these Access Terms shall pertain to the U.S. Government’s use and disclosure of the Snowflake Offerings and shall supersede any conflicting contractual terms or conditions. Government technical data and software rights related to the Snowflake Offerings include only those rights customarily provided to the public as defined in these Access Terms. This customary commercial license is provided in accordance with FAR 12.211 (Technical Data) and FAR 12.212 (Software) and, for Department of Defense transactions, DFAR 252.227-7015 (Technical Data Commercial Items).
Commercial Product. The Actor’s picture may not be used in conjunction with a commercial product unless the Producer has obtained the Actor’s prior written authorization and said authorization must specify the commercial product involved. If the Actor consents to the use of Actor’s name, voice, or photographic likeness, as aforesaid, Actor shall be paid not less than $100 for said use. Actors called to a picture call for the purpose described above, whether said call is at the theatre or elsewhere, shall be paid $100 or $25 per hour, whichever is greater, for said call, but shall be paid no additional sums for the use of pictures taken during said call.
