Commercial Containers. Franchisee shall furnish to all Commercial Customers appropriate Containers to Collect Solid Waste, Recyclable Martials, and Organic Materials at Commercial Premises. Containers with a capacity of one (1) cubic yard or more shall be available in standard sizes. The kind, size, and number of Containers furnished to particular Customers shall be as determined mutually by the Customer and Franchisee. Containers which are front-loading Bins shall have lids. Notwithstanding this Section, Franchisee shall not be required to provide Recyclable Materials Container(s) to a Commercial Customer that is exempted from Recyclable Materials services by the City or has demonstrated to the City that it is Diverting Recyclable Materials through another City-approved method, for the duration of the approved exemption. Similarly, Franchisee shall not be required to provide Organic Materials Container(s) to a Commercial Customer that is exempted from Organic Materials services by the City or has demonstrated to the City that it is Diverting Organic Materials through another City-approved method, for the duration of the approved exemption.
