Where an Employee is deemed to be unfit to work in her present position, the provisions of sub-clause 6.14.7 - Modification of Duties and Transfer to a Safe Job, may apply. An Employer may require evidence that would satisfy a reasonable person that the circumstances warrant allowing the Employee to take their period of paid maternity leave such that it would result in the Employee being on paid maternity leave more than 12 months after the birth of the child. Modification of Duties and Transfer to a Safe Job A pregnant Employee may work part time in one or more periods whilst she is pregnant where she provides her Employer with a medical certificate from a medical practitioner advising that part time employment is, because of her pregnancy, necessary or preferable.
