Commencement Date; Possession. Tenant shall accept the Premises in its “as is” condition on the Commencement Date. Landlord shall have no obligation to perform any work or make any installations in order to prepare the Premises for Tenant’s occupancy. Tenant represents and warrants to Landlord that the Premises are in Good Condition and satisfactory to Tenant and that Landlord shall have no obligation to perform or complete any work prior to or following the Commencement Date. Landlord shall not be liable for a failure to deliver possession of the Premises or any other space for any reason whatsoever, including, without limitation, due to the holdover or unlawful possession of such space by another party. LANDLORD MAKES NO WARRANTY OR REPRESENTATION REGARDING THE CONDITION OF THE PROPERTY OR THE SUITABILITY OF THE PREMISES FOR THE BUSINESS OF TENANT ANTICIPATED HEREIN.
