Common use of Collective Bargaining Agreements Clause in Contracts

Collective Bargaining Agreements. Neither Company nor any Company Subsidiary is party to, bound by, or negotiating any Collective Bargaining Agreement or any other Contract with any labor organization, union, works council, employee representative or association relating to the employees of Company or any Company Subsidiary.

Collective Bargaining Agreements. Neither Company the Corporation nor any Company Subsidiary is party toto any collective bargaining agreements with unionized employees. To the knowledge of the Corporation, bound by, no action has been taken or negotiating is being contemplated to organize or unionize any Collective Bargaining Agreement other employees of the Corporation or any other Contract with any labor organization, union, works council, employee representative or association relating to the employees of Company or any Company SubsidiarySubsidiary that would have a Material Adverse Effect.

Copies of all such agreements have heretofore been delivered to the employees of Company or any Company SubsidiaryBuyer.

To the knowledge of the Company, there are, and in the past five (5) years there have been, no organizing activities pending or threatened with respect to any employees of the Company Subsidiaryor any of the Subsidiaries.
