CLERKS WORK CLAUSE. 4.01 Subject to exclusions in Section 1 of this Agreement, all work in the handling and selling of merchandise in the retail stores of the Employer shall be performed only by employees of the Employer who are in the Bargaining Unit and who are members of the United Food and Commercial Workers Union, Local 1518, with the following exceptions:
CLERKS WORK CLAUSE. 4.01 With the exception of excluded personnel listed in Section 1 of this Agreement and Specialist personnel of the Employer all work in the handling and selling of merchandise in the retail stores of the Employer shall be performed only by employees of the bargaining unit who are members of UFCW Local 1518. The handling/selling of merchandise is handled by members of the bargaining unit with the exception of: Large vendors (specifically Canada Bread, Lays, Old Dutch, Coke, Pepsi) will continue their present practice of doing the initial stocking of product and leaving stock on hand. Bargaining unit employees do all their back stock. Small/boutique vendors will continue their current practice. It is not the intent of the Employer to utilize excluded personnel to deny hours to bargaining unit members.
CLERKS WORK CLAUSE. With the exception of excluded personnel listed in Section 1 of this Agreement, all work in the handling and selling of merchandise in the retail stores of the Employer shall be performed only by employees of the bargaining unit who are members of UFCW Local 1518. The parties agree to meet to discuss any additional third-party services that will impact existing employees’ hours of work prior to those services being put in place. No bargaining unit employee shall suffer a loss of hours as a direct result of excluded personnel in Section 1 of this Agreement working in the handling and selling of merchandise in the retails stores of the Employer.
CLERKS WORK CLAUSE. 4.01 With the exception of excluded personnel listed in Section 1 of this Agreement, all work in the handling and selling of merchandise shall be performed only by employees of the bargaining unit who are members of UFCW Local 1518.
CLERKS WORK CLAUSE. This Letter of Understanding reflects the discussions between the Employer and the Union regarding Office and Sales staff performing bargaining unit work. Certain Office and Sales staff currently perform bargaining unit work as part of their overall responsibility in managing certain areas or departments within Xxxxxxx Valley Wholesale. It is understood that this work is performed in the absence of Department Supervisors. It is agreed by the parties that these individuals will continue to perform this bargaining unit work as long as there is no Department Supervisor appointed to the specific area or department at which point none of these individuals will be permitted to perform bargaining unit work in that respective department. The parties will share a letter that specifically outlines the details of this work that was shared at the bargaining table.
CLERKS WORK CLAUSE. All work services connected with, or incidental to the operation of the Employer’s Retail Establishment, including handling or selling of all merchandise shall be performed only by employees within the appropriate unit as defined in this Agreement. The following are excluded from the preceding paragraph: Beverages, GMS Housewares, pet supplies, bread, crackers, cakes, cookies, milk, ice cream, potato chips, French's spices, and tobacco products. No supervisory employee shall perform clerks work, except in case of emergencies beyond the control of the Employer. In the event of a violation of this Article, the Employer will pay to the senior employee not working forty (40) hours that week, the amount of time spent in such violation at the employee's regular rates of pay. If this should result in the employee receiving more than forty (40) hours pay, the hours in excess of forty (40) would go to the next senior employee not working forty (40) hours that week.
CLERKS WORK CLAUSE. New Language It shall be a violation of this Agreement for General Xxxxxxx dise Clerks, Bakery Clerks, Floral Clerks and Salad/Bulk Food Clerks to perform regular clerk duties. Any such employees per forming regular clerk duties shall be paid in accordance with Sec tion 6.3 (b), (c) and (d) except at the rate of the next higher regular clerk rate bracket. Explanation — Work outside of the above job classifications would fall into the penalty clause for utility clerks as provided above.
CLERKS WORK CLAUSE. Subject to exclusions in Section 1 of this Agreement, all work in the handling and selling of merchandise in the retail stores of the Co-operative shall be performed only by employees of the Co-operative who are in the bargaining unit and who are members of the United Food and Commercial Workers Union, Local 1518 except those excluded in Section 1, and those specifically provided for here and elsewhere in the Collective Agreement. The Co-operative shall maintain the existing practice of outside sales people stocking their products on the sales floor including candles, pop, pizzas, local produce, and water. The Co-operative will endeavour to reduce this practice in the future where practical. The Co-operative further agrees that if the cleaning, maintenance and repair is to be performed by Co-operative employees, they shall also become members of the Union; although the Co-operative reserves the right to contract out this work again in the future.
CLERKS WORK CLAUSE. 7.1 No salesman shall handle or stock any merchandise in the store, excluding the meat department, except rack jobbers and driver- salesmen engaged in servicing the retail stores under prevailing practices with merchandise directly from a delivery vehicle at the point of delivery. It is understood that the above shall not apply in new stores during the first week after the store is opened. In the event of violation of this Section, the most senior employee working in that store at the time of the violation shall receive four (4) hours’ straight-time pay or straight-time pay in the amount of actual time spent in such violation. If more than one (1) person is invlolved in the violation, the two (2) senior clerks shall receive the violation pay.
CLERKS WORK CLAUSE. 7.01 With the exception of excluded personnel listed in Section 1 of this Agreement and salespersons or vendor representatives whose product is delivered directly to the store, all work in the handling and selling of merchandise in the retail stores of the Employer shall be performed only by employees of the bargaining unit who are members of UFCW Local 1518. All vendors that fall under the definition contained in the above paragraph as of the Sunday after the Award (SAA) 2011 shall be considered red-circled in the event their product is no longer delivered directly to the store. In effect nothing changes in the store with respect to vendor representatives working their stock in the Employer’s stores as is being done today. For example, the Employer may make arrangements with Coke to have their products, which are currently delivered directly to PriceSmart Foods stores, delivered to the Employer’s third-party warehouse providers and then shipped with other inventory to the stores. Should this occur the Coke representative will continue to work the Coke stock as they do today.
