Common use of Claims Not Released Clause in Contracts

Claims Not Released. The forgoing will not be deemed to release the Company or Executive from claims solely (a) to enforce this Release, (b) to enforce Section 6.1 of the Employment Agreement, (c) to enforce Section 5 of the Employment Agreement, or (c) for indemnification under the Company's By-Laws, under applicable law, under any indemnification agreement between the Company and Executive or under any similar arrangement.

Claims Not Released. The forgoing will not be deemed to release the Company or Executive from claims solely (ai) to enforce this Release, (bii) to enforce Section 6.1 of the Employment Agreement, (c8(b) to enforce Section 5 of the Employment Agreement, or (ciii) for indemnification under the Company's ’s By-Laws, under applicable law, under any indemnification agreement between the Company and Executive or under any similar arrangement.

Claims Not Released. The forgoing will not be deemed to release the Company Bank or Executive from claims solely (a) to enforce this Release, (b) to enforce Section 6.1 6.3/6.4 of the Employment Agreement, Agreement (c) to enforce Section 5 of the Employment Agreement, or (cd) for indemnification under the Company's Bank’s By-Laws, under applicable law, under any indemnification agreement between the Company Bank and Executive or under any similar arrangement.

Claims Not Released. The forgoing foregoing will not be deemed to release the Company or Executive from claims solely (ai) to enforce this Release, (b) to enforce Section 6.1 of Release or the Employment Agreement, (c) to enforce Section 5 of the Employment Letter Agreement, or (cii) for indemnification under the Company's ’s By-Laws, under applicable law, under any indemnification agreement between the Company and Executive or under any similar arrangement.

Claims Not Released. The In addition, the forgoing will not be deemed to release the Company or Executive Employee from claims solely (a) to enforce this Release, (b) to enforce Section 6.1 of the Employment Termination Agreement, (c) to enforce Section 5 of the Employment Confidentiality, Non-Competition and Non-Solicitation Agreement by and between Executive and the Company, executed concurrently herewith (the “Non-Compete Agreement, ”) or (cd) for indemnification under the Company's ’s By-Laws, under applicable law, under any indemnification agreement between the Company and Executive or under any similar arrangement.

The forgoing will not be deemed to release the Company or Executive from claims solely (ai) to enforce this Release, (bii) to enforce Section 6.1 of the Employment Agreement, (c) to enforce Section 5 9 of the Employment Agreement, or (ciii) for indemnification under the Company's By-Laws, under applicable law, under any indemnification agreement between the Company and Executive or under any similar arrangement.

The forgoing foregoing will not be deemed to release the Company or Executive from claims solely (ai) to enforce this Release, (bii) to enforce Section 6.1 8(b) of the Employment Agreement, (c) as revised pursuant to enforce Section 5 4.B of the Employment Letter Agreement, or (ciii) for indemnification under the Company's ’s By-Laws, under applicable law, under any indemnification agreement between the Company and Executive or under any similar arrangement.

Claims Not Released.
