Claims Incurred. For purposes of this Section 8.2(a), a claim or expense is deemed to be incurred (A) with respect to medical (including continuous hospitalization), dental, vision and/or prescription drug benefits, upon the rendering of health services giving rise to such claim or expense; (B) with respect to life insurance, accidental death and dismemberment and business travel accident insurance, upon the occurrence of the event giving rise to such claim or expense; and (C) with respect to long-term disability benefits, upon the date of an individual’s disability, as determined by the disability benefit insurance carrier or claim administrator, giving rise to such claim or expense.

Claims Incurred. For purposes of this Section 7.2(a), a claim or liability is deemed to be incurred (A) with respect to medical, dental, vision and/or prescription drug benefits, upon the rendering of health services giving rise to such claim or liability; (B) with respect to life insurance, accidental death and dismemberment and business travel accident insurance, upon the occurrence of the event giving rise to such claim or liability; (C) with respect to long-term disability benefits, upon the date of an individual’s disability, as determined by the disability benefit insurance carrier or claim administrator, giving rise to such claim or liability; and (D) with respect to a period of continuous hospitalization, upon the date of admission to the hospital, unless otherwise provided under the terms of the applicable RemainCo Welfare Plan or RemainCo Benefit Arrangement.
Claims Incurred. Claims for group health plan benefits shall be considered to be incurred prior to the Distribution Date if the services related to such claims were provided prior to the Distribution Date. Claims for all other welfare benefits shall be considered to be incurred prior to the Distribution Date if the date of loss occurred prior to the Distribution Date.
Claims Incurred. Claims for retiree health benefits shall be considered to be incurred prior to the Distribution Date if the services related to such claims were provided prior to the Distribution Date. Claims for all other retiree welfare benefits shall be considered to be incurred prior to the Distribution Date if the date of loss occurred prior to the Distribution Date.
Claims Incurred. Claims for health, dental and vision benefits shall be considered to be incurred prior to the applicable determination date if the services related to such claims were provided prior to such date. Claims for all other welfare benefits (including life, long-term disability, and short-term disability) shall be considered to be incurred prior to the applicable determination date if the date of loss or the date on which the disability or death occurred was prior to such date.
Claims Incurred. For purposes of this Agreement, including Section 2.03, claims shall be considered to be incurred as follows: (i) medical, vision, dental and/or prescription drug benefits (including hospital expenses), upon provision of the services, materials or supplies comprising any such benefits; and (ii) short-term and long-term disability, life, accidental death and dismemberment and business travel accident insurance benefits, upon the death, illness, injury or accident giving rise to such benefits.

Claims Incurred. For purposes of this Section 9.2(a), a claim or expense is deemed to be incurred (A) with respect to (I) medical (including continuous hospitalization), dental, vision and/or prescription drug benefits, upon the rendering of health services giving rise to such claim or expense; and (II) Medicare supplement premium reimbursement under the Post-65 Retiree Medical Reimbursement Account arrangement (the “HRA”), upon the date the supplemental health coverage premiums are paid; (B) with respect to life insurance, accidental death and dismemberment and business travel accident insurance, upon the occurrence of the event giving rise to such claim or expense; and (C) with respect to long-term disability benefits, upon the date of an individual’s disability, as determined by the disability benefit insurance carrier or claim administrator, giving rise to such claim or expense.
Claims Incurred. Claims for purposes of this Section 4.03 shall be considered to be incurred as follows: (i) health, dental, vision, employee assistance program and prescription drug benefits (including in respect of hospital confinement), upon provision of such services, materials or supplies and (ii) life, long-term disability, accidental death and dismemberment and business travel accident insurance benefits, upon the death, cessation of employment, injury, illness, or other event giving rise to such benefits.
Claims Incurred. Seller shall remain liable and retain responsibility for, and continue to pay in accordance with the terms of the applicable Business Benefit Plans, all expenses and benefits for each Purchaser Employee with respect to claims incurred by such Purchaser Employee (or his or her spouse and/or covered dependents and beneficiaries) prior to the Closing Date or the Deferred Closing Date, as applicable, and shall remain liable for workers compensation claims (including medical, disability, permanency and expense claims) incurred by any Purchaser Employee prior to the Closing Date or the Deferred Closing Date, as applicable. Purchaser or one of its Affiliates shall be responsible for all medical, life, insurance and other welfare plan expenses and benefits with respect to claims incurred by Purchaser Employees or their spouse and/or covered dependents on or after the Closing Date or the Deferred Closing Date, as applicable, as applicable (including, for the avoidance of doubt, any welfare plan claims incurred by a Purchaser Employee or his/her spouse and/or covered dependents on or after the Closing Date or the Deferred Closing Date, as applicable, that are submitted to a Business Benefit Plan) and shall be liable and responsible for workers compensation claims (including medical, disability, permanency and expense claims) incurred by any Purchaser Employee on or after the Closing Date or the Deferred Closing Date, as applicable. For purposes of this Section 5.6(g)(ii), a claim is deemed incurred: in the case of medical or dental benefits, when the services that are the subject of the claim are performed; in the case of life insurance, when the death occurs; in the case of accidental death and dismemberment or workers compensation claims, when the event giving rise to the claim occurs; and in the case of a claim that results in a hospital admission, on the date of admission. Notwithstanding the foregoing, effective as of the Closing Date or the Deferred Closing Date, as applicable, Purchaser or one of its Affiliates shall be responsible for all obligations with respect to claims incurred under the Purchaser Assumed Benefit Plans and/or the Miraclon Entity Benefit Plans.
