Claims Deadline. The date by which all Claim Forms must be postmarked or received by the Settlement Administrator to be considered timely. The Claims Deadline shall be sixty (60) calendar days from the initial mailing of the Class Notice to Settlement Class Members. The Claims Deadline will be clearly set forth in the Preliminary Approval Order as well as in the Class Notice and Claim Form.
Claims Deadline. Claim Forms must be received by [DATE]. Your other options. You will be bound by the terms of the settlement and unable to sue on your own unless you exclude yourself in writing by [DATE]. If you want to stay in the settlement, you may object by [DATE]. The Court will hold a hearing on [DATE] to consider whether to approve the settlement and to award attorneys’ fees and expenses, and Service Awards for the Class Representatives. Claims Deadline. The deadline for submitting Claim Forms set by the Court in the Preliminary Approval Order.
Claims Deadline. Any Claim for reimbursement from the Escrowed Property must be asserted in writing by Buyer by means of a Claims Notice received by Sellers and the Escrow Agent prior to 5:00 p.m. (Houston, Texas time) prior to the close of business on the first business day after the date which is three years from the date of this Agreement.
Claims Deadline. 6.2.1. In order to be eligible for approval and payment, Claim Forms must be timely and submitted on or before the Claims Deadline.
6.2.2. The Claims Deadline shall be set on a date at least ninety (90) days after the dissemination of Notice, subject to Court approval.
6.2.3. The date on which the Claims Deadline falls shall be clearly set forth in any order granting preliminary approval to the Settlement as well as in the Notices and the Claim Form itself.
Claims Deadline. In order to be eligible to receive a share of the Monetary Benefit under Option A or Option B, a Settlement Class Member must submit online or by mail a completed Claim Form within sixty (60) days from the last of the following dates: the date E-mail Notice, Text Message Notice, or Postcard Notice is disseminated (hereafter, the “Claims Deadline”). For a Claim Form to be considered timely, the completed Claim Form must be submitted online by 11:59 p.m. Pacific Time on the Claims Deadline, or if submitted by regular mail, postmarked by said date. The Claims Deadline shall be set forth clearly in the Notice.
Claims Deadline. All Settlement Class Members have ninety (90) days after the Notice Date to make Claims for Settlement Benefits by submitting a Claim Form to the Settlement Administrator. The Claim Form must be postmarked or electronically submitted online within 90 days after the Notice Date. The Notice to the Settlement Class will specify this deadline and other relevant dates described herein. The Claim Form must be verified by the Settlement Class Member with a statement that his or her claim is true and correct to the best of his or her knowledge and belief and is being made under penalty of perjury. Notarization shall not be required.
Claims Deadline. Within four (4) Business Days after the Claims Deadline, the Escrow Agent shall:
(i) retain an amount of Escrow Funds (after taking into account any distribution to the Seller Representative pursuant to Section 4(a)(i)) equal to the aggregate amount of (without duplication) (A) all Unresolved Claims existing as of the Claims Deadline, if any, (B) any Final Claims which have not yet been disbursed to the Indemnified Party with such amounts to be held and distributed in accordance with Section 3(d)(iii), and (C) the amount of any Distributable Interest Amount for any year or partial year for which Buyer has or will have Allocated Income that has not yet been disbursed to Buyer in accordance with Section 8(c); and
(ii) distribute the remaining Escrow Funds, if any, to the Seller Representative.
Claims Deadline. Pursuant to the Settlement Agreement, Settlement Class members who wish to receive a distribution from the Settlement Fund shall submit a completed Affirmation of Claim Form via the Settlement Website, or postmarked or received by fax by [DATE], the last date of the Claim Period, in accordance with the procedures set forth in the Settlement Agreement. The Settlement Administrator shall not honor without Defendants’ permission (which may be withheld in its discretion) any Affirmation of Claim Form that is untimely, even if such Affirmation of Claim Form would be otherwise valid. If a Settlement Class Member timely submits an Affirmation of Claim Form, but fails to fully and accurately complete the Affirmation of Claims Form or otherwise provide the necessary information set forth in the Settlement Agreement prior to the deadline to submit a claim, the Affirmation of Claim Form will be deemed invalid and rejected.
Claims Deadline. “Claims Deadline” means the deadline to submit a Claim under Section III(A) of the Settlement, which shall be not more than ninety (90) days after the Class Notice is published.
