City of San Jose. General Aggregate Liability Insurance or bodily injury, property damage and personal injury and all risk legal liability coverage in an amount equal to 100 percent of the replacement costs of that portion of premises occupied by the City of San Jose. The City of San insurance shall be primary and any coverage required to be maintained by the Owner shall be in excess to the coverage required to be provided by the City of San Jose and not contributive to City of San Insurance. Copies of said poli- cies or certificates thereof shall be deposited with the Owner and the City of San Jose shall obtainthe written agreement of the insurers to notify the Owner in writing thirty (30) days prior to any cancellation for reduction of insurance. The City of San Jose may satisfy such insurance requirements by endorsement to existing policies and shall provide copies of the required endorsements to Owner. The City of San Jose shall not sell, or permit to be kept, used or sold, in or about the premises any article, which may be prohibited, by the standard form of fire insurance policies.

  • Environmental Protection Borrower shall not, and shall not permit any of its Subsidiaries to, directly or indirectly (a) use (or permit any tenant to use) any of their respective Properties or assets for the handling, processing, storage, transportation, or disposal of any Hazardous Material, (b) generate any Hazardous Material in violation of Environmental Laws, (c) conduct any activity that is likely to cause a Release or threatened Release of any Hazardous Material in violation of Environmental Laws, or (d) otherwise conduct any activity or use any of their respective Properties or assets in any manner that is likely to violate any Environmental Law or create any Environmental Liabilities for which Borrower or any of its Subsidiaries would be responsible.
