Channel Capacity. The Company agrees to make available channel capacity, up to one (1) fully dedicated Channel position, on the digital tier to be designated for non-commercial, non-revenue generating public, educational, or governmental (“PEG”) access purposes; provided, however, that this obligation shall not take effect until such time as the Franchising Authority certifies that it will satisfy the programming terms set forth in Section 9.2. Upon activation, unused time on the PEG Channel position may be utilized by the Company subject to terms to be mutually agreed upon by the Company and the Franchising Authority.
Channel Capacity. The Franchisee shall construct, at a minimum, a system that provides a minimum capacity of 750 MHz and that is designed in a way so that it can deliver the channels in a manner reasonably responsive to customer demand. The system shall be designed so that the number of channels may be increased as supply and demand for additional channel utilization exceeds the number initially activated and so that the capacity of the Cable System may be increased without substantial reconstruction of the Cable System.
Channel Capacity. The Grantee will maintain on its Cable System a minimum capacity of activated analog and/or digital Channels. The System will throughout the Term of this Franchise carry reverse signals in the upstream direction. The system performance, capacity and services offered may be reviewed to assure the system keeps pace with changes in technology and is at least comparable to other systems in the area. Channel Capacity. (A) Prior to the Effective Date of this Franchise, Grantee upgraded its Cable System to a Fiber to the Fiber node Cable System architecture, with Fiber Optic cable deployed from Grantee’s Headend to Grantee’s Fiber nodes, tying into Grantee’s coaxial Cable System already serving Subscribers. Active and passive devices currently are passing a minimum of 860 MHz (with a minimum passband of between 50 and 860 MHz) providing to Residential Subscribers at least 200 or more activated minimum Downstream video Channels and minimum Activated Upstream digital Channel Capacity of 35 MHz accessible from any node, any Residential Subscriber, any Access facility, and any I-Net Site in the Franchise Area. This Upstream Capacity requires no additional installation of equipment for use except on users’ premises.
Channel Capacity. The System has the capacity of carrying Fifty- ---------------- Four (54) Six (6) MHz downstream channels over 100% of the System. The System provides reception on all such channels in compliance with the requirements of the Franchises, in full compliance with the Rules and Regulations, and meets all the material technical standards of (S) 76.605 of the Rules and Regulations which are legally required to be met by the System. The System is authorized to utilize all frequencies currently used in the frequency bands 108-136 and 225- 400 MHz in the manner currently used.

Channel Capacity. The Subscriber Network shall be capable of passing frequencies of at least eight hundred sixty (860) MHz cable bandwidth. The Subscriber Network shall have a Downstream bandwidth of at least eight hundred eight (808) MHz, ranging from fifty-two (52) MHz to eight hundred sixty (860) MHz. The Downstream bandwidth shall be allocated between Analog Channels and Digital Services, and the allocation may change over time. The Subscriber Network shall be capable of delivering eighty (80) six (6) MHz Analog Channels (counting Channels A-1 and A-2) of television programming. The Subscriber Network shall also be capable of providing over two hundred (200) Digital Services, which may include television, audio, data and cable modem services. The Upstream bandwidth shall be not less that thirty- five (35) MHz, ranging from five (5) MHz to forty (40) MHz and, as of the Effective Date, is anticipated to be used exclusively for digital Signals.
