Changes without Supplier’s consent. If the Customer makes any changes to IT environment, Software or equipment which are not described in the Contract, without the Supplier’s consent, and if this has a significant impact on the proper functions of the Delivery, the Supplier is entitled to require to be released from any future obligation in relation to the Delivery, including the obligation of taking corrective action, undertaking maintenance and support as well as Operation (if applicable), as and when this is reasonably justifiable. Any reinstatement by the Customer of the original situation will cause the Supplier’s obligations to revive. The Supplier is entitled to verify that the original situation has been reinstated, and to be remunerated therefor by a reasonable amount calculated on the basis of time spent. The Supplier will consent in advance to the Customer and/or its management operator carrying out standard maintenance and support and Operation, provided this does not in- volve any interventive action contrary to Appendix 5 or Appendix 15.
